Hello , need some advice, Im in USA, without legal status, I came with a tourist visa 7 years ago with my wife and a 1 year old son, I have now 2 more kids born in USA, im from Mexixo and Im Lawyer, but of course I cant work in USA, I have a good bussines cleaning new homes and doing good, but I like to back to my profession and feel good about my status, so I thinking in Canada, so, my questions are if I can apply to PR with my family in my current situation in USA? Can be for the express entrance program? Can I use my profession even if I dont practice 7 years ago? Can I use my experice like enterprise to aply? Can we aply in USA or we have to go to Mexico? Any in my family have any legal problem and my company is in good status, Help please!!! Thanks.

You can't use any of your work experience from the last 7 years to qualify for Express Entry since that work experience was gained illegally. Do you still qualify for Express Entry without the last 7 years of work experience?

You can apply from the US but will eventually have to send your passports to Mexico for visa stamping (if you are accepted). If an interview is required, it will also be held in Mexico (not in the US).

Where is US do you live?

Why you want to go to Canada? It's cold everywhere except BC.

Regarding your question.

You were self employed? Have you paid taxes? You have proof of funds and income?

About English - you need to pass IELTS or CELPIP

What education you have and what age you are?

Additionally it is way less job opportunity in Canada compare to California alone.
Salary is twice lower.
In addition you need to get Canadian licensing - which I suspect is different.

OP is in the US illegally and most likely has no way of gaining legal status (the only way he/she could do this at this point is if his/her spouse was American). That's why he/she is looking to Canada.

Also, just to add, I assume you know that as soon as you leave the US you will be automatically banned from re-entering for 10 years.

Thanks, well I live in Utah and actually the weather shows more cold today than Canada, but anyway, I was a Tax auditor in Mexico for 2 years before USA, can use that experience? Yes I make my taxes all years for me and my company, even I have a good credit score, I can buy anything exept for a house, and I have 35

Biggest hurdle: You cannot submit an application to Canada if you´re not legally residing in your current country. Canada nor any other country is going to clean you being illegally in US !!!!
2nd hurdle: Lawyer is a regulated profession in almost all countries because law is specific to every country. You would have to do exams to get license for working as a lawyer anywhere.

If you want to work as lawyer and be legal in the country, go back to Mexico. Is good country to live with. I have lived for 3 years and half "legally" in Distrito Federal and life is OK.

If not continue ilegal in US, lots of people do that and even die ilegal in US, without any problem

People go from Mexico to US without visas, it is massive.
Hundreds of thousands do so!

If the guy paid taxes during all this 7 years then situation is much better for him.
US is not so strict as a Canada. There is way more unofficial work then in Canada.

I suggest that men should stay in US.

It is good place anyway. Don't go back to Mexico - salary is low there!

US is not so strict as a Canada. There is way more unofficial work then in Canada.
Canada is far more lax than the US when it comes to overstays. There is no automatic ban in Canada for those who overstay their visas. In the US, an automatic ban of three years is given for overstays of 180 days or more - and an automatic 10 year ban for overstays of 360 days or more. The situation is not good for the OP in the US, since unless he has an American spouse - it will be impossible for him to legalize his status in the US without first leaving the US for at least 10 years. If he qualifies to immigrate to Canada, he could get legal status here much much faster. Of course continuing to live illegally in the US is also an option.

Actually - you can. And we certainly have members who have done this successfully. There's nothing stopping someone from submitting an immigration application while they are in a country without status. Having said that, they cannot apply through that country's visa office (since they have no status in that country). They must apply through the visa office of their home country.
