HELP!! Express Entry Applicant Adding New Spouse Issue

Hello All,

My situation is as follows:

I currently have an Express Entry application in the final stage of the process (waiting approval from an immigration officer). I am getting married in August. My fiancée (Brazilian citizen) is currently illegally living in our country of residence. Once married she will become legal in our country. The issue is that our country of residence (Ireland) will NOT issue her a short stay visa until her Irish PR application is finalized. This process takes at least 12 months.

Our plan is that I add her to my visa once married and when possible move straight to Canada. We are worried Canadian immigration will not issue her PR if she is waiting for a PR decision in Ireland.

Has anybody faced a similar situation?

Does it matter that she is waiting for a PR decision in Ireland while we apply for Canada?

Adding her to your application will delay your PR. You will also need to send some support documents about her like passport & visa stamps + Irish police record, etc. If she is living in Ireland illegally, it might create some problems to get her approved for PR in Canada. It might be worth waiting until her situation is legalised in Ireland.

You’re welcome.

Adding a spouse to your PR after you sent your application will always delay it’s processing time. Since you need to inform IRCC and give supporting documents that need to be processed. You can see IRCC's post here about what makes an application complex.

I don’t have a spouse in the same situation as yours. But since you need to give a police record and IRCC runs a background check and security check, I can just assume that being illegally in a country won’t been seen positively when you are applying for a visa for another country. Hence why I would wait for your spouse's situation to be normalised in Ireland before looking to go to Canada.

I am looking for somebody who has been through this process and come out the other side.

If anybody has had their spouse in the situation with an undocumented past please let me know how that process went :)
