Hi,

I am an Indian artist. I studied In Emily Carr University in Vancouver from 2009-2011.

I got a 3 year work permit. Between those years i was traveling between India and Canada so didn't apply for my PR.

Over the 3 years I have worked as a freelance artist in Vancouver.

In 2014 I applied for my PR, but my lawyer said I can't apply for PR because I was not a full time employee.

My work permit expired in 2014 and I stayed back in Vancouver till 2016 on getting my Temporary Visa extended.

I am presently in India and wishing to settle and return to Vancouver with a work permit.

Can i apply for PR from India ? How do I get back to Canada ?

Do you have one year of full time work experience in a NOC that is skill level A, B or 0?

As a motion graphics artist and video editor i have freelanced across a few studios in Vancouver, but not worked as a full time staff. So yes I have more than ONE year of part time work experience.

"have at least 12 months of full-time (or an equal amount in part-time) skilled work experience in Canada in the three years before you apply,"

I fall under Skill Level A, as a trained professional, in motion graphics and video editing. I have a Bachelors in Fine Arts degree.

Having one year of part time work experience won't qualify you for CEC. You need to have the equivalent of one year of full time experience (this can be gained part time).

In other words, when you add up all of your part time hours and then divide them by 30 - do you end up with 52 or more?

HI,

In case I end up with more than 52..then what is the next step ?

Suppose I have less than the required hours for CEC, what are my options, considering I am not in Canada...

How can i still get my PR process going ?

If you have 52 or more - then you can create an Express Entry profile (assuming you have language test results and have had your education officially evaluated) and hope you have enough points to be selected under the Canadian Experience Class (CEC) stream.

If you have less than 52, you don't qualify to apply under CEC.

Hi,

Thank you for your reply. In case I don't apply for CEC under the stipulated number for hours, can I apply under the Self Employed Category ?

The working hours are not a requisite there, and I have professional film and video experience of 10 years, across Canada and India.

Please advice.

Last time I checked it was taking ~ 68 months for self employed PR approval. You're probably better of waiting until you have the accumulated hours to apply for CEC.

That's a little misleading. You don't need to be "full time" but you do need to be an employee - Canadian self-employment ("free lance") experience is excluded. (It is accepted as foreign work experience, however).

Can i apply for PR from India ? How do I get back to Canada ?

Do you have any other skilled work experience, in India? Have you also been self-employed as an artist there?

Yes, I have work experience in India from 2007-2016, as a professional film editor. My work has been screened on Knowledge Network, which is a Canadian English-language public educational cable television network in the province of British Columbia. My edited documentary has premiered in 2009 in Toronto Hot Docs, and in 2015, my directed film had its world premiere in Montreal.

So yeah I have some Canadian and Indian work experience and recognition.

So with a degree in BFA from Emily Carr University + 1 year of freelance work experience in Vancouver + 10 years of Internationally recognized film experience, will it be difficult for me to get PR under CEC ?
