Hi

Called CIC yesterday and they said my application is considered complete and I should get notification of approval Oct 16 which means the application goes back to start over again as I sent the original July 10th. They count the 9 months from the day of approval according to CIC.

They count 9 months from the day is it sent to the Visa Office in Havana. And it sounds like the exact same thing that happened to me, because I sent in the paper they were missing, and i didn't receive any acknowledgement that it was complete so I called in and they said it was complete, yet a few weeks later I received the letter again saying I was missing Imm1341 or whatever. So i sent it again and then in May they sent it to Havana. If you haven't sent in that paper you definitely should because they are all over the place at CIC.

My question was if anyone knows how long from "in process" to decision made. I know processing time is 9 months, my status just changed to in process on August 20, 2014 and I called CIC and they said that the 9 months is from the time it arrives in Havana...so it arrived in Havana in May, 9 months equals February 2015, but it is already "in process" so I can't see it being 9 months from that day...is there anyone in this thread whose partner has landed in Canada?

FYI, received my AOR from Havana today. SA was approved Aug 26, so 3 wks to arrive in Cuba.

Hi

We are wondering if anyone has had this experience or can offer advice. My husband had to get a new police clearance and when it came back it said there was a trafficing record on it. This is not anything that he was ever charged with. How do we get it off the police file as it will be an issue weith immigration. I was in Holguin at the time this was supposed to happen and he was with me so could not have committed the crime.

I'm not sure if a traffic record would make him inadmissible. If he was not charged or convicted, then I'm not sure how that can make him inadmissible;

"Under Canada’s immigration law, if you have committed or been convicted of a crime, you may not be allowed into Canada. In other words, you may be “criminally inadmissible.”"

but if there is no charge or conviction, I don't know how they can see that as a risk.

Ultimately, I think he needs to find out why it is on his record, and if it is in error (which would not surprise me... it took them 3 times to get my husbands right... wrong name, wrong birth date) get it corrected!!!

Hi

It is a mistake as he has a clean record as per his first police clearance and this was a crime apparently done in regards to selling jewellery art and a fine of 3302 pecos. To top it all I just got back fom Cuba last night and received an email from CIC saying I need to complete Imm 5406 or my husband does I am so stressed now I feel this is becoming too much to handle He has a 26 yr old daughter who now has a husband and a baby and will not be coming to canada.

Hi Galano,

Did you not fill out the form when submitting the file? It should be your husband who fills out the form as principal applicant. You go on the form as his spouse. His mother and father should be on there and his daughter and any brothers or sisters but his daughter's husband and baby does not need to be on the form.

On your IMM008, what did you put as an answer to number 3? how many people are on the application?

It sounds to me, the answer should be 1, because you are not including his daughter, because she is over 19 and does not qualify under this version of a family sponsorship.
If for some reason she is on the application, then that would be why they are looking at it as an accompanying family member, and you have in fact applied to sponsor her. The section about dependants, I don't think should be filled out either, based on the definition of a dependant. The only place her name should be in on the "family information" form of your husband.

When the child is under 19, then you HAVE TO include them on the application, regardless of if they are coming, so that should you wish to sponsor them later under the family class (that is, until they reach 19 yr old) you can. If they are not on the form, then they are not considered part of the family class.

Dependent children "Refers to the children of the applicant or those of the spouse or common-law partner.
They must be:

under the age of 19 and not have a spouse or common-law partner, or
19 years of age or older and unable to be financially self-sufficient since before the age of 19 due to a physical or mental condition
."

As for the 5406, is says the following:

Additional Family Information (IMM 5406)

Who needs to fill out this application form?

This form must be completed by:

You, as the principal applicant,
Your spouse or common-law partner (whether accompanying you to Canada or not), and
Your dependent children aged 18 or over (whether accompanying you to Canada or not)."


I would call CIC to find out why they think that she is a dependent child.

I found the same thing as MrsHubby as well as that the A2 Family Visa that you get is only valid for 60 days so you have to leave the country every 60 days.

I wouldn't trust to do it by mail. I would take the tourist card you get on entry to a consular office where your hubby lives to get it "upgraded" to a family visa.

Hi

My understanding is that the Canadian Tourist card you get on the plane is good for 3 months. I know we can live in a Casa Particular for that long. So I am looking at only 60 days in his house Is that correct ? Do they want a passport photo ?
