The process is taking longer than expected and I may need to apply for a work permit(for certain reason),even knowing that my ppr could come anyday. The form says application for work permit made outside of canada, so im not sure if I can only apply inside of Canada. Im here as a visitor from the states. Any thoughts, help, suggestions? thank you.

What process are you applying for?

It is important to know this in order to answer whether you may apply for a work permit from within Canada or not.

I havent tried looking for someone yet, I'm just trying to see if it's possible to apply from inside Canada before I waste my time and the employers time.

If you are in Canada as a visitor you would not be eligible to apply for a work permit from within Canada.

You would need a job offer, LMO and apply either at a port of entry or from a country where you have status of at least a year.

and certain other people in Canada. That is why it was important to know about the individual's status at present to answer the question - to know if they were able to apply for a permit from inside Canada or not.

You're from the US - correct?

You can't apply from within Canada. However if your employer gets a positive LMO, it's my understanding that you can flagpole at a Canada/US land border crossing (i.e. leave Canada and then re-enter) to activate a work permit. Along with the LMO, you would need to bring a completed work permit application and the applicable fees.

Eligibility to apply from inside Canada

You can only apply for a work permit from inside Canada if:

you have a valid study or work permit, or your spouse or parents have a study or work permit
you have a work permit for one job but want to apply for a work permit for a different job
you have a temporary resident permit that is valid for six months or more or
you are in Canada because you have already applied for permanent residence from inside Canada. You will have to pass certain stages in the main application process before you can be eligible for a work permit.

You must also have the following documents:

a job offer from a Canadian employer
a completed application, that shows that you meet the requirements of the Immigration and Refugee Protection Act and the Immigration and Refugee Protection Regulations, and
written confirmation from HRSDC that the employer can hire a foreign worker to fill the job. This confirmation is called a positive labour market opinion.
In most cases, it is up to your employer to get that written confirmation. Information on the labour market opinion is found under Information for Canadian employers on the right-hand side of this page.
In some cases, you do not need a labour market opinion. (See Jobs that require a work permit but no labour market opinion.)

You must also do the following:

Satisfy an immigration officer that you will leave Canada at the end of your work permit.
Show that you have enough money to support yourself and your family while you are in Canada.
Respect the law and have no criminal record. (You may have to provide a police clearance certificate. See Police Certificates for more information.
Show that you are not a risk to the security of Canada.
Be in good health. (You may have to have a medical examination.)

It is now possible to apply online for a work permit from within Canada. Please see Apply online for your work permit from within Canada in the Related Links at the bottom of this page.

@ Scylla

Hi Scylla, how are you? :)

I'm in a similar situation. I have applied for the CAQ/LMO a month ago (Montreal) and will hopefully get them soon, and will then apply for the new work permit with my new employer. (no open permit)

My current work permit will expire by the end of july 2012. (currently my PR is in process in Buffalo... waiting for AOR.....)

Regarding the Flag poling issue, is it true that i can just take my whole application kit with me straight to the border, do the "flag poling"-thing and give the whole application kit + fees to them and they will do process it right there? (will possibly take 2 hours...)
Meaning i don't need to apply online within Canada, or possibly in Berlin, Germany?
I've read it would take online about 2-3 weeks, in berlin, germany about 2 months. .....never mind the waiting...used to it...
The Flag poling thing should be done latest the day my current permit expires in order not to be kicked out i guess....

What is your best guess, please? :) Never done the flag poling....lucky me the border is only 30min away from here...

Thanks a lot,

greetings,
lepatissier07
