with my case i remember that my lawyer sent all the evidence at once . from when we started the apllication. not at the end . and even if we had an exceptional reason to stay , my lawyer only took the money from us when i received my PR.. I remenbered him saying " not fair for u guys to pay me if we are not sucessful. ".. great lawyer , gerat human being...

Hello.I just applied for H&C. I have a daughter who is 13 year-old. She has health problem so she can't go back to our home country because Canada is the best place for her as so many reasons. I have a question. She is not going to school right now and I am not able to work right now as we just applied. How long did it take to get your open work permit? My daughter is not able to go to school until we get it?

your 13 year old daughter - is she not in school because of her health problems or because of your immigration status?

are you based in the GTA?

my understanding is it is mandatory for all children aged 6 and above to be in school regardless of immigration status.

in some cases, proof of submission of H&C application is sufficient as it is an application for permanent residency and you have not received a response / result of said application

i suggest you go to your nearest public school and enroll her if possible

Hello there.

I came to Canada from US, so i was ineligible to apply for refugee claim, CBSA advised me to apply PRRA and its currently pending. I got married in canada to a protected person (PR application Pending) also we have a Canadian citizen baby. I applied for H&C they returned my application saying Im not eligible to apply for H&C because I have PRRA pending.

Anyone in this situation please advise.

Your daughter's check-ups will become less regular as she grows older is not a sufficient H&C reason. She is not actively sick. Also don't believe Iraq is on the list of countries where there are no removal orders. Actually not being accepted as a refugee but not being able to be deported is not situation I would recommend. Hopefully you have some other reasons or proof that H&C will find compelling.
My H&C was based on being not able to be deported and refused

Too early to tell. Current processing times for H&C is 29 months and they have a low approval rate. I wouldn't expect to hear much from IRCC for about another year, but that's just a guess. All depends on the case load.

Do you still think that ridiculous and gaming the system?

Of course being able to apply for H&C 5 times is ridiculous. It takes up resources for other 1st time H&C cases and costs the taxpayers hundreds of thousands of dollars to process.

But every times I had to pay for processing fee, I don’t think taxpayers are paying instead of me to process my application

The fees you pay do not cover the costs of processing the application. Taxpayers end up covering approx 50%.

How they cover 50%? And remember I’m not only the applicant for H&C there are dozens of thousands of people applying and sum all of them are big amounts

The remaining portion covered through the annual taxes people pay. In other words, a portion of the federal taxes paid by Canadian taxpayers go towards funding immigration process and operations. The fees paid by applicants only covers a portion of the total processing fee. This is true for all immigration applications, not just H&C. And yes, a lot of money is collected through fees but this is not enough to cover the costs of actually processing the applications. Because about half of the cost is covered by taxpayers, this means the application fees are lower.

So basically assuming you obtain PR and later citizenship, even once you are a citizen, a portion of the taxes you pay annually as a Canadian will go towards paying for immigration operations even though you yourself are no longer going through the process or have an active application.

There are certainly people who have complained about this and feel that applicants should be responsible for paying fees that cover the full costs of processing. This would likely increase fees x2 or x3 for applicants.

If the upcoming election goes on favour of the Conservatives, we can expect further reductions in immigrants quotas and likely other changes that will be negative to those going through the process. Anyone who is trying to immigrate or sponsor family members or get a work permit or study permit should be praying that the Liberals stay in power.

Actually much more than 50% for H&Cs because they are more labour intensive than other forms of PR applications. Also doesn’t count things like legal aid which many use.
