Those who had an h&c application in process, and then later filed refugee application.. does the refugee application nullify the h&c application ? Mine has been there for 12months and i was also asked to do biometrics a couple of months into the h&c process. I will have a refugee hearing later may be this year. If the h&c processing time comes, and they decide to provide aip, will they give me a chance to withdraw the refugee claim ? Or will they return the application ? I don't understand why they haven't returned it yet. I am worried if they play ping pong and i get to deal with it. Both claims are genuine but i don't trust the government anymore given the latest anti-immigration stance they are choosing to portray including just yesterday in Mississauga.
i think you can not have both application together ( Refugee + H and C )

IRCC and IRB often put one application on hold while they process the other. Most do not apply for asylum and H&C at the same time but are already at the JR stage when they apply for H&C so tough to say what will happen. Did a lawyer suggest you apply for both at the same time? Both defeats the purpose and somewhat undermines the asylum case if you applied for H&C if you believe you have grounds for asylum. You should have picked the program that was the most relevant and likely with the higher chance of success given your situation.
Hello Everyone i emailed Niagara and received a reply that says my H&C application is on hold, reason: i have an open refugee file. And won't proceed until its closed. My question i dont have any file ooen with the refugee board i even called them and they told me its has been closed since my case was also dismissed at the federal court since 2 years ago. So what exactly can i do at this point?. Anyone had this situation before? At this point i am very confused about everything. Its so frustrating honestly.
The RAD may just be sitting in a pile waiting to be assessed. There is a long backlog of AIPs waiting to be assessed for final approval.
I got Interim Work Authorization also though my H&C is only 9 months. I’m suspecting it’s because I became eligible for PRRA this month.

When i called last week i was only told my application is still within processing limits. Nothing about pending refugee claim, nothing about anything else. Just the processing time.
