H&C Humanitarian Ground with/or Without Failed refugee claim

Nothing related to H&C pauses removal but you can petition to have removal put on hold until the outcome of JR. It is up to CBSA. You’ll have to be prove IRCC made an error while considering your H&C claim to get a positive JR. Not sure how you can know you will file an H&C claim not knowing any details about why you were denied in the first place.
How will I know the reasons. These days they are just copy pasting generic stuff to everybody. Probably it’s those reasons. Or they followed rad decisions.
Do you have family in Canada ? Did you work or study ? Do you pay your bills ? Are you volunteering ?
Likely no longer enough to get H&C. The days of easy H&C approval are likely over.
JD is based on proving an error in the determination of H&C so you literally need to know why you were denied.

It happened 2019 to 2021.
The data shows that the rate of refusal of Humanitarian and Compassionate grounds applications rose from 35 per cent in 2019 to nearly 70 per cent in early 2021. This does not include withdrawn applications.

There is a huge volume of applications with a decreasing quota. We are anecdotally seeing more refusals. We are also likely to see action after an H&C denial instead of no action, person remains in Canada and people keep applying for H&C over and over again. Canada is trying to reduce the volume of temporary residents so they can’t approve everyone’s application just because of time spent in Canada.
Yes and even their approach is significantly changed when I called them. She didn’t give me any proper response and just said, background check for your application is at very early stage. I don’t know how long more we need to wait. When I googled it that background check takes a month for normal applications and a year for complex applications. They should change the program name since there is no humanitarian and compassionate anymore.
