If ircc reject your h &c application would they reject ur work permit too
Did they reject your application?if so then when did you get a response from them?what was the rejection reason(if you dont mind sharing),after waiting for how many months you got a response from them?

Hi everyone, I wanted to know if anyone has any experience with my situation. I’m underaged and my family applied H&C with my mom as the Principal Applicant. We submitted April 2024 and received refusal decision on October 2024. It only took 6 months. I have a younger sister, 8 years old and Canadian. My family has been here for 10 years. We have family and friends who are PR. After refusal for the H&C, we applied for Judicial Review. What do you think our chances are at successful JR? (P.S. The officer wrote that he think it’s in the best interest of my younger sister and I for my family to remain in Canada, but he still refused the case). How long will it take to receive news for the JR? And can we apply for stay of removal or anything else to stop the deportation order while we wait for the JR decisions? Thank you so much. My family and I have been so stressed and worried about our situation right now. We won’t be able to find good jobs to maintain our living expenses with 3 kids in our home country.

Your family can certainly try to have any removal put on hold. Always up to CBSA. The ability to have a similar lifestyle in a home country is not typically great grounds for H&C especially these days. Inability to access education, healthcare, your sister not speaking the language of your home country, inability to access medical care if you have a chronic health issue, etc. How old are you and your other sibling? Are both parents working? Could your family support themselves without any form of government payment? If you are 18 you likely have a much better chance applying on your own but you’d need to be prepared to remain in Canada on your own if approved and prove that you could financially support yourself. You really need to review all the points made in the H&C refusal. How did your family move to Canada and what has been your status since arrival?

If you have not applied for JR already have you not already exceeded the time you had to apply?

The ability to have a similar lifestyle in a home country is not typically great grounds for H&C especially these days. We did bring up points about inability to access education as my older sister and I are no longer fluent in the language of our home country. Our skills are comparable to that of a 10 year old. We also brought up the fact that my younger sister can’t speak the language and she’s only ever been in Canada. I am currently 17, will be turning 18 this year. My older sister is 20 years old and will be turning 21 this year. Both my parents, and my older sister, were working before they took their work permit away. My family does not take any government support money, except for the time of Covid.
My family moved to Canada in 2015 and we applied for refugee in 2016. We appealed but got refused so we decided to apply for H&C since we’ve established our lives in Canada by then.
