Hi everyone, I wonder if anyone can help us out on the GST credit thing ???

We're living in BC now. I entered Canada in Oct 2013, got married to my husband (PR) in Nov 2013, now am in the process of the PR application. Last week, my husband received a letter sent from CRA saying:

"our records show that your current marital status isnot thw same as the one we used to calculate your 2012 GST/HSTC/BCCATC. As a result, we cannot determine if you are still entitled." And they are asking us to provide the confirmation of our marital status andthe date of the change, as well as my name & SIN number. They also need to know my net 2012 net income to calculate my husband's credit.

I saw the payment period is July 2013 to June 2014, and the base year is 2012. Now the accounting summary stated on the letter saying my husband is owing them CAD244.90 and need to pay this amount?!?! :eek:

My husband has just filed his tax return of 2013 and paid almost a thousand for the tax owing (he was doing two jobs to make more money to support our life as I cannot work here while waiting for my PR!) - and now he has to again pay the GST?! ???

Can someone be so kind enough to explain us on this?

We're going to call CRA later to figure out what to sort it out too.......we don't even know how to provide the SIN number as I didn't have one now :-[

Not sure what tax bracket ur husband is on, but when I filed my taxes with my husband (at the time common-law) for 2012, I had to pay back over $200 in gst and otb bcs of the change in marital status! We both received a refund from tax return, but I had to repay the gst credit since our combined income was high
You can call to doubke check, but if he is making more money (second job) he wouldnt be entitles to gst Crédit!

Hi Ortom, thanks very much for your response and sharing. yes, i guess we can only call to double check with CRA and figure out how to provide the information they need (as i don't have SIN number) to determine my husband's credit. If we have to pay then we can only pay :-X

By the way, i can understand that he might not be entities to get GST credit if he was making more money by doing two job...but should we expecting to have a in debit owing in this circumstance ? ??? Just confused.

Yes - it's entirely possible your husband may have to pay money back that he wasn't entitled to receive.

What was your husband's marital status for the base year of 2012? If he wasn't common-law or married and was in an income bracket which entitled him to the GST credit then this is a probably a mistake by CRA based on confusion of changing his status to married. If you were only dating in 2012 then your income is of no relevance to his 2012 filing. But if he was making more money that pushed him into a different income bracket, which happened to me too, then he does owe the money back. This last tax year I owed $190 for GST I wasn't entitled to since I received a raise at work. So that does happen.

CRA likes to make mistakes. When I changed my marital status in Oct 2013 after I got married, CRA sent the same kind of inquiry - wanting proof of my marital status for the base year they were reassessing - 2012 - to present. But when I sent my information they totally misunderstood me and they went back all the way to 2010 & 2011 to change my marital status - at the time common-law with my ex - to single and said i owed over $2500. I had to go through this whole appeal process to get that reversed. Pain in the ass. Anyway, whatever you do, make sure you explain yourselves properly...If you believe he was entitled to that GST as a single person, make sure you explain that to CRA.

Just to clarify, he is not paying anything again. He received GST credit from the government of Canada. If they determine that he was not entitled to receive that credit, he would be required to pay it back.

Hi marlasinger, thanks for this.

I was dating with my husband in 2012 and went back to my country at the same year...so we both were single in 2012. He started taking the 2nd job as a part-time in 2013...so he got to pay the tax while he file his tax of year 2013.

Guess we are just not very clear how they calculate the credit and which period the refund he got belong to... ??? we will find it out, i hope.

After receiving a letter about GST and confirming our date of marriage, we had to pay over 500$ because of his income and I am not allowed to get GST credit anymore.

i saw the notice states "payment period" is July 2013 to June 2014 with a calculation base year of 2012, the summary now is debits 244.90. Does this means that he should not be entitled to receive those credit during the above period? And the money he is going to pay back is for the money he got during this period?

i know after getting married, only one person can claim the GST/HST credit...but how come you would have to pay that much back ???

That is correct. Same thing happened to me and my husband, we ended up paying back our GST. I was confused about the base year of 2012, as we were not married then, but the call representative explained me that in order to pay us for the period of 2013 JULY to 2014 JUNE they had to look at 2012 incomes, as our taxes were not filed yet for 2013 (the year we got married). You probably received that GST some time in December 2013 (and you filed your taxes for 2013 only in March or April 2014), so that makes sense they have to look wayyyy back to calculate the amount u are entitled to. So yes, that is all correct and I suggest pay it back as soon as you can, otherwise they are fast to charge you interest on it.

So we should pay it back first then provide the information and find out if he was entitled the credit or not?
