Hello,

My wife and I have a visitor visa to canada.
My wife is 6 months pregnant, and we are thinking of traveling to canada next month, when she will be 7 months pregnant, and stay there for a couple of month to give birth there so our child can become canadian.

My question is;

Is that LEGAL ? Are we allowed to travel there and give birth there ? Is there any law that prevents that ?

And if they ask us on the borders, should we say the truth about our plans ? and if we do, can they prevent us from going in to Canada ?

NB: We have a private medical insurance that covers the delivery in Canada, so expenses are not an issue.

Yes - your wife can give birth in Canada. There is no law against it.

However there is a chance you and your wife could be refused entry into the country if the immigration officers see she is pregnant when you arrive and suspect you have plans to remain in Canada long term (i.e. overstay your visa).

Assuming you are allowed into the country, you will be responsible for paying all costs related to the pregnancy (as visitor you do not have access to health care benefits). Assume the costs will be somewhere around $7K to $10K for a hospital birth. However be aware they could be significantly higher if here are complications.

Hi,
Just wanted to check if you guys traveled to Canada or not? Did you face any issues at the immigration? You have any idea about that if a child is born in Canada and parents are on a visit visa, does the child get the Canadian passport? Would appreciate your help/advice on this.

yes, maily chines people do that, travel to canada, get baby born overthere and the baby get canadian citizenship, i heard that there is some amendment for such kind of issue to prevent baby borders

Thanks for the reply. I heard there was an amendment as well. But can't find it online anywhere. Does anyone know? Where can I check if there has been any amendment?

No amendment has been passed. If a child is born in Canada that child is Canadian.

If the officer can spot your wife as pregnant then for sure you will be questioned about the plans. If you lie the chances are 50-50, you may be allowed if you have evident information handy or you may be sent back with not much questions.

Now come to the expense part, I am quite surprised how an overseas insurance company promises to pay all the child birth expenses, hope they know the charges over here in Canada.

Doctor visits, ultrasound, blood tests wouldnt cost that much but the moment you get admitted in the hospital thats where the numbers roll. The ultrasound at hospital costs 4000CAD$, the delivery charges depend on if its a normal or C-section.

Do your homework or on the safer side call up the hospital to check the charges before you board a flight thinking it could be only 7-10K.

Nowadays there will be more control for people who want to give birth in Canada. A lot of Chinese people do that and leave the bill for the Canadian tax payer. So if the immigration officer suspects this, you will be refused entry to Canada.
