Getting married right before visa expires

Is it bad that im having my wedding right before his working visa expires??? Our wedding is Nov 20 2010 and his working visa expires Dec15 2010???

Getting married just before the visa expiry can be seen as getting married just for the sake of immigration. According to the new law, it can cause your sponsorship to be denied even though you prove that your relationship is genuine. Do you qualify to apply as a common law couple?

Well we couldnt apply for that because we will be married. I dont think I fully understand what im getting involved in here. Sounds to me that when I get married in Nov and he goes back in Dec I wont be seeing him again in Canada

We did not say you would be denied, we are saying that there is a possibility.

BTW if you are only getting married to have him back in Canada, you may wish to know more about your role as a Sponsor.

You may also wish to investigate timelines for inland and out land applications. There is a jamaican thread that might be useful for you to read on the experiences there.

I am not marrying him just to get him back in Canada. And I have read my responsiblities as a sponsor and understand that part of it. Im just trying to find out if he can stay here in Canada with me while I process the papers because I dont want to be away from him that long

When his work visa is about to expire, you can apply to change his status to visitor based on your intention to file for sponsorship. If you are already married and have already filed for sponsorship at that point, even better. If you file inland, you can send the visit status request with your application as they both go to Vegreville. If you file inland, they will not deny his request for visitor status as it is a requirement for the inland application that he stays in Canada. If you file outland, it is not a requirement for him to be in Canada so they could deny his visit status request but I have yet not heard of somebody who already was in Canada who was not approved to stay as a visitor while filing for sponsorship.
