Hello there! My daughter and I are being sponsored by my boyfriend. We are going to do the common law option. What is worrying me is my background check! I have been doing so much reading online and wanted to know if my driving without a license/suspended license is going to affect our application? I have two charges of that and also I have a possession with marijuana charge. The marijuana charge was going to be dismissed but it was not due to me being in Canada at the time of the last court date. I have read that Canada will translate the American charge into Canadian code and I wanted to see if that was true? Please anyone if you have insight on this please let me know! Thank you in advanced everyone!

I suggest that you contact an immigration lawyer that offers a free phone consultation.

It's quite possible that these issues may impact your PR application. Having 2 charges for driving without a license is a bigger deal in Canada than it is in the U.S., and the marijuana charge only adds to the `potential' problem for you.

Also...you have been living with your partner for at least 1 full year...and have plenty of evidence to support that, right?

Yes, the charges WILL be equated to Canadian law. I have no idea how bad the driving without a license is going to effect you, but because you were arrested/charged with possession then you essentially 'skipped' out on those charges, that is what is going to come around and bite you right in the ass end. You missed an essential court date that would've resolved this last issue for you, instead it only made it bigger.

Ponga gave you the best advice. You are likely going to find a LOT of roadblocks because of your history. Find a consultant/lawyer that is WELL VERSED in inadmissibility issues and go over it with them to get an idea of where you stand. You might only need to have a consultation with them to decide whether or not you can proceed with your application.

Yes I have evidence of everything to proof we are a legit couple. The only thing that worries me is my criminal history. Where can I find a lawyer with free over the phone consultation? Thank you so much for responding guys.
