Well, folks... it finally came, the rejection letter. I had applied under 0213. The foreboding delay itself made me suspect that things are not good. Here are my details, which hopefully would benefit the future applicants. Suggestions are welcome.

Time line:
Applied to Sydney, NS: January 23, 2009
Received AOR from Sydney: February 19, 2009
Sent full documents to New Delhi CHC: March 30, 2009
'Not eligible for processing' Letter: Dated April 20, posted June 4, received June 8, 2009.
e-CAS status since May 13: Visa office eligibility review complete.

The gist of the letter is this:
You have indicated that you have work exp in an occupation with the following NOC code 0213. Although the NOC code corresponds to an occupation specified in the instructions, you do not have a minimum of one year of continuous full-time or equivalent part-time paid work experience in this occupation in the last ten years. Since you did not provide evidence that you have work experience in the listed occupation, you do not meet the requirements of the ministerial instructions and your application is not eligible for processing.

My profile is: Job title: Director, Data Processing. The Indo-Swiss joint venture is owned by me and my husband and was incorporated in 2006, since which time I've been working there. Since 1999, I've been working in the managerial cadre in the ITES industry (maybe they are looking for pure IT managers only).

Evidence provided for the latest job:
Company formation letter which lists me as the Director. Did not provide an appointment letter since I was also the owner.
Reference from the Managing Director (who is also my husband. I had pointed out this fact myself and also included the business card of our CEO, who's in Switzerland). I had taken care to put the job details/responsibilities closely matching those given at the NOC.
1 year's bank statement which showed the salary credited every month.

Somehow, I was under the impression that Sydney, NS was the tough nut to crack when it comes to the NOC list and ND would be a walk in the park. Apparently not! I had been running around for the PCC, proof of funds and IELTS (overall band 8), all to no avail. I'm genuinely surprised that they didn't even ask for further evidence, which proves what the Seniors have been saying here: there will only be one shot at this; they will not come back to you asking for more evidence.

Anyway, I'm going to give it another try by asking the CEO to fax the CHC directly explaining my job responsibilities. However, I don't think it'd make much of a difference since they have already rejected my case and not asked for further evidence. The only solace is, since they've determined that I'm 'not eligible' they have promised to refund the processing fee within 4 to 6 weeks.

I know it's too early, but is there anybody who has appealed their case after a rejection at the second stage? If yes, please let me know how you went about it.

I think, i'll land up in the same boat as you. My employer has a clear policy of not giving anythin in written. So, all the job description details and proof of employment, etc is framed by me. I hardly think, they'll approve my case looking at your status.

did they mention anywhere if they will be refunding any kind of money to you?

HI,

I am also applying under 0213.

I worked as Analyst for more then 1 year having most of the duties thay are looking for.

But my experience letter only tells my Job Title and my good performance there.

Please guide what to do.

My heart felt apologies for the rejection, I was wondering did you receive an AOR from New Delhi after you sent the documents to New Delhi or they just directly sent you the Rejection Letter without the AOR?

Could you elaborate on the duties you mentioned as a Director, Data Processing? The NOC does co relate to pure IT Managers, it maybe that the duties you listed on your experience letter does not correpond to the list of duties they are looking for as an It Manager.

The previous employment is not part of the NOC List this is the only reason why I think, because they have mentioned that you do not have 1 year work experience in this NOC which definately points out to the duties..

It is sad hearing your rejection. But just wondering about what went wrong.
Since you are going to re-apply, what have you thought went wrong. You mentioned that you wrote your duties resembling the ones mentioned for code 0213.

Charmeuse I think we need to decide what went wrong so that you dont repeat it and give them what they want.

1...What are your qualifications and did they match as an IT manager.
2.... If your qualfications and duties match the ones mentioned for 0213 then you can expect a positive response surely.

We had similar case, I co owned a paint company here Philippines but i only qualified under NOC 9212 as supervisor in a chemical manufacturing. My job title is manager and director for the last 10 years but all job descriptions falls under the NOC 9212 as we had applied. My ecas is still "in process" since start although I had sent my updated documents last march 6 and I filed my case since Nov., AOR Dec and request letter Jan. I had a consultant here and they had polished and review it before filing it as it worries me that I'm applying as supervisor only which I'm not. My consultant and forum members assures me that the job title is not important as long as the main duties reflect what is listed on the NOC still crossing finger here...

Dear charmeuse:

It seems like they thought that this is your family owned company so all kinds of documentary evidence will be available be it payslip or bank statement or designation. That's why they denied. Visa officer has enough discretioney rights to do anything.
