Dear experts, Need advice to response SGVO. I got a mail mentioning subject "30-day Procedural Fairness on Work Experience" from SPOREIMMIGRATION @ international.gc.ca

Dear Mr ABC,

This refers to your application for a permanent resident visa to Canada.

I have assessed your application and there is insufficient evidence to show that you meet the minimal requirements as per subsection 75(2) of the Immigration and Refugee Protection Regulations. Subsection 75(2) states that a foreign national is a skilled worker if:

(a) within ten years preceding the date of their application for a permanent resident visa, they have at least one year of continuous full-time employment (30 hours/week) experience, or the equivalent in continuous part-time employment in one or more occupations, other than a restricted occupation, that are listed in Skill Type 0 Management Occupations or Skill Levels A or B of the National Occupational Classification matrix;

(b) during that period of employment they performed the actions described in the lead statement for the occupation as set out in the occupational descriptions of the National Occupational Classification; and

(c) during that period of employment they performed a substantial number of the main duties of the occupation as set out in the occupational descriptions of the National Occupational Classification, including all of the essential duties.

I am not satisfied that you meet all three parts of these requirements. You have provided insufficient evidence to satisfy me that you have performed the action described in the lead statement, and a substantial number of the main duties, of the occupation as set out in NOC 2281 Computer network technicians.

If you have any additional information to add to your application you should forward this to our office within thirty (30) days of the date of this letter.

for your info I applied in 2281 and emphasis my JD as System Admin as it is also mentioned in example titles and I attached current month salary mentioning join date and job status from HR. But in my recent Experience letter (from Divisional Head) I mentioned my administrative designation (like officer, Sr. Officer) but in my previous experience I mentioned my Functional designation as that is also administrative designation (like UNIX Administrator).

BTW another thing is my divisional head is changed and now from whom I should take another Reference Letter.

Hi Bro,

Please go through the below links and make sure you will submit a new ref letter from your divisional head / deviational HR / your group HR. I think you can't go back to lower designated personal issues ref letter because you already submit the ref letter from your higher position personnel from our company. Otherwise it will make another confusion. It would be better from same person or other person but same position.

Hi Afsan Apu,

First of all I would suggest you that not to worry about your letter received by today.
You need to handle it patiently where there will be no any dispute from your latest submission of reference letter.

You already received lot of feedback from seniors and collect all of them and deal with carefully.

As from me, I can only suggest to make sure the below points are include your latest reference letter submission. Also make sure all of the paper should be updated in the latest date of submission.

For employment reference you present have the following characteristics:

  • The reference must be on the official letterhead of the company;

  • The letterhead should indicate clearly the full address of the company and any telephone, telex or facsimile numbers;

  • The name and position of the person authorised to sign the employment reference should be typed or stamped below that person's signature – a reference with an illegible signature will not be accepted; preferably a senior manager or above of a company.

  • The contact details i.e. telephone number of the person writing the reference should be indicated on the letter.

  • Business card/ visiting card of authorized signatory's is preferable to provide.

  • The letter should indicate the exact period of employment (exact date is preferable, including whether permanent or temporary, full or part-time, state the number of hours worked in a week), position/s held, at least the FIVE MAIN DUTTES UNDERTAKEN and salary earned – positions should not be described by generic titles (eg research officer, public servant) but according to the nature of the duties undertaken (eg research chemist, account clerk);

  • Payslips from your current employment should also be included.

Hope for the best ... :) :) :)

In the letter it was written 'You have provided insufficient evidence to satisfy me that you have performed the action described in the lead statement, and a substantial number of the main duties of the occupation as set out in NOC 0112 Human Resource Managers.'

After that just the usual lines about providing 30 days to give evidence and six month's pay slip.

So in reply, I gave a cover letter with my promotion letters, company ID, company visiting card, some notices issued by me as part of HR duties, Letters issued from and to HR, few photos, recommendation letter from a colleague and a few other HR related docs by me. I could have provided more. Unfortunately i did not get the permission from the supervisor.

Initially my application had Reference letter by MD, salary account statement and job contract.

Hope my reply helps. :)

Dear Afsun1105,
In my linkedin profile I noticed that 4 unknown persons visited my profile in last 15 days, but as my account is basic one, not premium I can not see who they are, do you have any idea how can I get details of those persons, I am suspecting someone like mysterious Sup C might have visited my profile.

Also like your one my NOC is 0112, I am passing very hard time now being tensed about my application progress, got AOR about one and half month ago. Will ask you for help if SVO ask me to provide with any further document, hope you would kindly be in my help.

Dear Seniors,
1. Can anyone please define me what is a lead statement means?

2. The experience/recommendation letter I provided with my application contains 21 duties, though all are correct, now I am very tensed that how they would take this. Observing some discussion in this forum I have come to understand that a good JD should includes maximum 6 to 7 duties. Do you think that it will be a problem for me as I mentioned more than expected duties. My NOC is 0112 and got AOR 1 months ago.

Thanks in advance.

Please note that I applied under NOC 0111, app received 13 june 2014.

I provided the following documents with app:

Job Ref letter from MD in company pad
Employment contract in company pad
Salary statement in company pad
Joining letter
My card and MD's card etc

Pls also note that in all forms (Schedule 3 and Generic form) I mentioned my NOC 0111.

But in the enclosed separate sheet (where I have shown how many points I claim for experience, age, language etc etc) it is mentioned that

''I am qualified for Thirteen (13) units of assessment (for experience 4 years+) in this category as Financial Manager (NOC 0111) or Financial Auditors and Accountant (NOC 1111) or Other Financial Officers" (actually my consultant has written like this)

In the above mail case officer said that my job duties and responsibilities don't match with 1111/auditors and accountant (?) but I applied for 0111/financial manager which I mentioned everywhere

Pls suggest me-

1) What other documents I can provide
2) How to explain or solve NOC 0111 problem

Thanks in advance

One thing I could not understand when the Visa Office is saying -

"I am not satisfied that you meet all three parts of these requirements. You have provided insufficient evidence to satisfy me that you have performed the action described in the lead statement, and a substantial number of the main duties, of the occupation as set out in NOC"

doesn't it emphasis on the reference letter? If it is so, is there any scope to include additional duties or lead statement in the latest reference letter?

If visa office has doubt about the duties whether that applicant really performs the duties or not, then applicant has to submit the internal documents of the company to proof. Is it possible to disclose company documents to outsiders?

Your consultant is really super stupid Sir, VOs are really rushing and busy and if you write something confuse them, then they will definitely reply your not satisfied email.

0111 and 1111 are so similar isn't it? What do you wanna VO to do? Let VO decide 0111 or 1111? You should never write 2 NOCs in any explaination letter to confuse them.

Please just provide a letter ask the VO to focus on 0111 which you are applying. Never talk about 1111

What I feel your supporting could not clarify 2 main points which is also stated in their letter "I am not satisfied that you meet all three parts of these requirements. You have provided insufficient evidence to satisfy me that you have performed the action described in the lead statement, and a substantial number of the main duties, of the occupation as set out in NOC 2281 Computer network technicians."

In that case in my opinion you can provide them with a strong supporting for the following:
1. Lead statement matching evidence and
2. JD matching Evidence

These documents can be your job objective statement from HR which states all the objectives that you are responsible for.
A reference letter with your Supervisor and HR Head as joint signatory to tackle the situation arise from the change of your Divisional Head.

Of course these should be carefully written so that it does not conflict with previous experience letter that you have provided already. Please be sure that you are following the procedure of the reference letter as prescribed int he Document checklist.

Now you need to provide everything again but your current job ref letter should be in current till date. Also please provide your details JD description, also if you have some evidence like your company group pictures, any award, join any training or any training certificate which will lead your job description by your lead statement.

You should mention again your main duties like -

Establish, operate, maintain and co-ordinate the use of local and wide area networks (LANs and WANs), mainframe networks, hardware, software and related computer equipment. set up and maintain Internet and intranet Web sites and Web-server hardware and software, and monitor and optimize network connectivity and performance. etc.

Bro, I am not your NOC but I wanted to summarize it. Please make sure you will not provide above as it is but for your easy understanding you need to provide it elaborately your main duties and lead statement with your working procedure along with your new current ref letter.

The main point is you have to prove that your job duty covers this NOC's objectives....

Hope you could manage it and confidently submit it.

Wish you all the best..
