FSW - 2014 for already employed in CANADA

Hi - I am planning to apply under 2173 code SW Engineer and Designer for 2014 under FSW. I know the 10,000 CAP limit is already filled for 2173, but I am already working as a full time employer in Canada..I believe this CAP is applicable for those who don't have a job offer or for those who don't already a permanent employment in Canada. Could you please confirm. I have all the documents ready, planning to send it to CIC tomorrow..

In the checklist for FSW under Arranged employment; there are 2 documents requested:
1. Offer letter for those who found a offer of employment in Canada
2. WP copy for those who are already working in Canada.

As I am already working in Canada, can I just submit the WP copy and my original offer letter which i got i joined here.. Please confirm..

The job offer has to be permanent and has to be LMO approved to be eligible for arranged employment category. Go through CIC's website to make sure you understand everything you need to apply.

It looks like you are working in Canada under an intra-company transfter - which is LMIA exempt. This means your employer must obtain an approved LMIA if you want to apply under FSW -arranged employment. If your employer would just be starting the LMIA process now, then it certainly will not be done before the end of December.

I noticed that for express entry next year CIC is awarding 600 points for job offer, will my intra company transfer offer letter be accepted as a job offer in order to attain those 600 points...

I checked with my Immigrations team and since our company is under GATS category, they have mentioned that LMO is not required and even when I originally applied for my Work permit they mentioned the same..
Can anyone please confirm if the company falls under GATS category then dont we need the positive LMO...

U can still apply under arranged employment even tho if u dont have a positive lmia; but it is ONLY for certain types of lmia exemptions. Maybe ur work permit falls under that category, Double check that.

And for express entry. No matter how on earth u got a work permit (with or witout lmia). U will still need a positive lmia to be considered to have job offer (for the extra 600 points).

U can try to get around it by applying to pnp. Maybe there are some provinces that accept job offers without lmia. That's what i am looking for now
