All...

The only reason for rejection is spouse Birth certificate, only this was highlighted in the returned form and the letter. I did'nt get a PER.

I thought Matriculation will be taken as proof so kept that, but it did not work. I know it worked for few people, but again it depends on who gets to look at your app. After massive effort on IELTS, universities, Education valuation, going after companies for work experience letters, you will certainly need a bit of luck to get through. In this case I was totally out of it :-(

My take on this is, try to put only BC instead of other documents. You never know how your app can be returned, and once returned you will not be able to do anything since the form is returned in the initial review itself. If you have PER assigned, then you can send explanation and additional documentation.
This is sad to know that your Application returned back....according to me this process should be automated and must work like EOI system...(like few countries have such system in place and working successfully).

Can you please let me know if you have also sent marriage certificate ? which usually contains date of birth of both.

I have sent everything - marriage certificate, metriculation, passport copies -. But I could not send birth certificate, because I dont have one for my spouse... In India, many people dont have BC's, probably you have to go to your town, or village or do whatever and try to get it.

One thing I dont understand is, why spouse BC is required. I did'nt claim any points for my Spouse on age and almost every country other than Canada understand's problems with BC in some countries and usually consider passport copies as proof. This defies logic.

Dear kumar

Spouse BC is required because they check integrity of all applicants data..whether birth date same on passport and BC and marriage certi ext this allows cic to gain confidence of consistency n integrity of documents..
They simply says how it is possible to get passport without BC.

kumars,

Very sad to hear about the this. Did you provide affidavit for not having BC along with Marticulation certification ? I am asking because as I also do not have BC so I had to send Affidavit along with Marticulation Certificate.

I got my packet back. The reason for rejection is Spouse Birth certificate.

To get app rejected for such a small reason, after so much of efforts, is a setback. I have kept matriculation certificate, as BC was not available, but it seemed to be of no use.
So sorry to hear abt ur case.....I did sent 10th certificate and got PER also.

Let me clarify this to all my Indian fellows-->

Anyone born in India before 1989 does not require Birth certificate but those born after 1989 BC is compulsary.

Please search google and u will get lot of links where it is categorically stated abt BC requirement after 1989.

Fortunately, I and my spouse were born before 1989 and we both didn't fell into this trap.

Hi Md.Azad,

Just wondering what stops CIC from processing our cases. We are both 0211. Did you ever apply immigration to Canada before? My case is yes, I did apply and had an UCI. But there is nothing showing from ECAS.
Hello Friend kencreech,

No,this is my first time try for Canada. Is RBC the main culprit ? I have no idea for such delay.I called CIC several times.Mailed to them 10 days ago.But they did not reply yet.If they reject the application, they can clearly communicate with us without keeping in such stress.

Yes, I went through this and that is why I have sent an affidavit stating that I have not been issued any BC along with Matric Certificate. I am born before 1st Jan, 1989. I think it should work, right? or is there really a matter of luck ?

They do return applications for silly reasons ... Like Spouse Birth Cert ... ! They even lost ppl's IELTS TRF .. I do not think they are efficient at all in dealing with Immigration... for applicants part, it needs luck, ability to run around like a jet before lodgment, super accuracy in filling every little insignificant details and what not .... The missing ingredient is? Guess what, QUALITY of the Applicant ,,, ! Which was the whole Idea of bringing Skilled Migrants.

Australian SkillSelect is what's gonna replace this age-old Canadian Immigration system ... THe only downside is AU Visa Fee is way high.. but atleast qualified candidates have a proper shot, not dependent on Luck but Qualification.

Yes may be. But in India passport agency knows this problem, and accepts matriculation certificate as proof of DOB.

Lot of other big nations do accept passport as proof as they take cognizance of this fact in countries like India, but Canada has it's own rules and we have to accept that.
In the end Immigration is prerogative of the country to accept us according to their rules, and not a right of the applicant.

Amit,
we all understand this rule, but from CIC officials point of View, how you can explain this rule to them as so they dont return our application back., ( I am just thinking from Canadian Immigration perspective).
