Ok I finally finished filling out all the paper work for applying for permanent residence from within Canada: Spouse or common-law partner in Canada class (IMM 5289) and it says in the guide:

Who may not use this application package?

•If the person you want to sponsor lives outside Canada.
•If you intend to appeal if the application is refused.


Ok I'm here visiting with my husband. I live in the states.. I'm ok to stay til November but in October we plan on applying to extend my stay while we send in the paper work above ^^^ (IMM5289) Did I fill out the right paper work because we want to do inland where I can stay during the process....I'm freaking out :'(

I haven't submitted it yet. We want the one that will allow me to live with my husband during the process...

Which is the one that will allow me to stay with my husband while the paperwork is being processed? I thought inland was this one http://www.cic.gc.ca/english/information/applications/spouse.asp because it says apply to sponsor from within Canada :(

Looking at your first post again, I think you got the right form :)

Oh good lord THANK YOU! I spent every day for the last week crunching down on this application and the thought that I didn't fill out the right one...(insert me pulling my hair out) :eek: Thanks so much..

Just curious (and nosy ;)) as to why you chose inland instead of outland?

I know you've already filled out the inland app and I don't want to stress you any further :) but are you aware that you can file outland while staying in Canada as a visitor?

I only mention this because outland would be a faster process for you than inland. As a visa-exempt American, you can easily extend your visitor status in Canada while the app processes. As well, you aren't stuck in Canada for 1.5 years like you might be if you apply inland.

This is definitely something to consider. At the time we applied (October of last year), we thought that, since I intended to stay with my husband in Québec for the duration of our application process, we *had* to apply inland. We thought it was "misrepresentation" to apply outland while I was here. Now we know better, thanks to this forum, but it was too late by the time we learned we could've applied outland. I have felt very trapped here, as it is advised that inland applicants do not leave Canada at all until their process is complete. We got very, very lucky and just got DM (decision made) 10 months in, but this is NOT the norm. There is no way to know how long your app will take. CIC currently states that 80% of inland applications are complete (have a DM - there is still a bit do do after, landing and waiting for your PR card) within 18 months. Yes, some are completed much faster. HOWEVER, note that 20% of inland apps still aren't finished after a year and a half!

Not trying to freak you out, but certainly, there were quite a few months when I wished very hard that I could go back in time and submit an outland application. It's something to consider carefully at the beginning of the process.

I do love the fact that outland is faster but I'm worried about getting a visitor extension and how long it can be extended for because as of right now I have no where to go in the states :( I was working and living with family but was told as of a few days ago that they do not welcome me back in their home due to circumstances beyond their control....so you can see why I might be hesitant to go outland....I'm in bit of a pickle. I just want to be with my husband :(

I can definitely understand why you'd be nervous but I've not seen a case on here of an American in the middle of an sponsorship app being denied an extension. There are many Americans on here who have extended their visitor status while waiting for PR, some for several years. Apply for the extension in October and ask for a year, explaining that you have applied for PR (include proof like the receipt or sponsor approval if you have it by then). As long as you can show enough finances to support your stay (proof of your husband's income is sufficient), you have little chance of being refused.

You can start a new thread and ask some of the Americans on here about their extensions. There are quite a few in the same position; off the top of my head, I know one of them is "amikety", who stayed in Canada for a few years before and during the whole process.

I think it's okay that you're applying inland, if you don't think you'll need to appeal and you don't intend to travel while waiting for AIP. (My understanding is that it's generally okay to travel after AIP if necessary, because the risk of not being allowed back in is really low after that).

To extend your status during an inland application, you need to include an application for an open work permit along with the PR application. This is what gives you "implied status."
