Hi everyone,
My and I have had to recently go through a issue when it comes to immigrating to Canada with a dependent child.
We received a letter from Immigration Canada (Sao Paulo Brazil) requesting additional documents for the proof of custody of her son. She had 100% custody physically, as her son lives with her, but her ex had visitation rights.
In our application we sent court documents stating she was the "legal" guardian, and sent a sworn statement and notarized document from her ex saying that he allowed his son to immigrate to Canada. Form IMM5604 was not part of the application package when It was sent to CPC-M. Only 1 week later that form was mandatory.
I called the Embassy, and they were adamant that she needed 100% full custody no questions ask, if not but you are $#%#% out of luck. Well they didn't swear haha..![Stick Out Tongue :p :p](data:image/gif;base64,R0lGODlhAQABAIAAAAAAAP///yH5BAEAAAAALAAAAAABAAEAAAIBRAA7)
So we had to go to the courts, through a lawyer of course, to change the document with written consent of the father to relinquish his parental rights (which he agreed to do thank god!!)
This whole process took 10 days from start to finish and published in the newspaper and about 450$. We we very lucky as all the lawyers wanted to charge 1200$ US...
The usual time is 60 days from start to finish, but we showed the judge that the embassy required this asap and it was a matter of urgency. god was surely on our side for this step.
Documents to be delivered today, and again wait... wait... wait... wait....
