Flagpoled to Get New Work Permit - Question about original employer

Our prospective nanny flagpoled today and got her new work permit. She is now in the LCP, rather than a regular TFW. However, we did not intend to have her start with us until July 1. So she was going to give her original/current employer 2 weeks notice on June 15.

My question is - how risky is it for her to continue with this employer until July 1? Will this employer be notified by CIC that her work permit with him was cancelled? Should she tell him what has happened? Is this cause for concern?

No the new employer will not be notified by CIC. I've read before that the old WP gets cancelled when the new one gets approved but I am not very sure about this. Just tell her to obtain a ROE from her employer when she goes.

It does get cancelled. You cannot legally hold more than one work permit at a time. However, as I mentioned previously, it's not a big issue for CIC/CBSA when it comes to enforcement. I wouldn't recommend longer than 4 weeks of her continuing to work for her current employer though. Where this could be an issue later is when she applies for permanent residence if she took a long time to start working for you after the new WP is issued and kept working for the first employer. I wouldn't push it any longer if I were her because it could bite her later.

Shoot! We can't have her start for 6 weeks! Because it took so long for her paperwork, we hired a temporary nanny, and in order to get a temporary person we had to promise we would employ them until at least June 30. So I can't have our new nanny start earlier than that.

Why does the government make it so difficult to get these work permits!? We would have waited until closer to her start date, except that it is so hard to get to the border from her, and when her friend offered to take her all that way this weekend, we just jumped on the opportunity. Now we're in another pickle! Ok, vent over...

Not really. It's just two weeks that you are really dealing with. She could take vacation or even keep working. Didn't mean to scare you as a 6 week difference is not going to be seen as a big deal like a 6 MONTH difference would.

Thanks for letting me know. Yes, we are definitely just going to "lay low" and have her work out her 6 weeks; we don't have any other option. She says her family (back in the Philippines) needs the money so she can't take vacation time. We will just keep our fingers crossed that CIC never notices/takes issue with this.
