I badly need your help. I have a friend, a Pinay, who is married to a Filipino husband, but separated for more than ten years. The husband's location is unknown. They're not legally separated and marriage is not annulled yet. Well, she have this Barangay Certificate certifying that Pinay and her husband is no longer living together and there's no way possible to reunite again.
Now, Pinay is dating a Canadian guy for more than 3 years now. Canadian is visiting Pinay here in PH once a year and they go out of the country trip, just the two of them. They have plans of getting married in Canada.
My question is:
1. Is it possible for Pinay to get married in Canada with Canadian even if Pinay's marriage to Filipino is not yet dissolved?
2. Once Pinay's TRV is approved, can she file a divorce or take an oath in Canada for Declaration of Severance (to Filipino), so Canadian can file Family Class Spousal?

If she wants her boyfriend can sponsor her even if your friend is in the Philippines as conjugal partners, but the chances are slim.
Now if she can be granted TRV and she can live with her Canadian boyfriend for 12 mos they are considered common-law partner and the boyfriend can sponsor her but they need more proofs of relationship.
