Filapino vs Canadian nurses in the eyes of U.S. immigration

Next question..... I have been on a TN Visa for 15 years which expires in a couple of years. I have an approved I140 application with an inclusion date of 2007. I am becoming a little freaked out as my hospital in the united states has several filapino nurses that will soon be going home because their allotted time has run out and they can no longer get extensions.

Are the filapino nurses different in the eyes of the U.S. compared to Canadian nurses on TN??

With all the issues with immigration, unemployment, and illegal immigration it would seem that the wait has become ridiculous for permanent residency.

Well, look at this scenario. If you return back to Canada and work as a nurse, you would probably earn at least $60,000 before taxes and overtime. If a Filipino nurse returns home to the Philippines, the would earn nothing more than $6,000-per-annum. So you see there is a huge wage difference betweena Canadian and Filipino nurses, so US immigration will obviously view a Canadian nurse as different.

I think you might be trying to abuse the TN visa system. Remember it's not a dual-intent visa and if the US Immigration authority sees that you are trying to use this visa as a permanent residence in the US, you will be DENIED the next time you try to renew the TN. My advise to you, switch to an H1B visa before you get married or try to seek permanent US residence or citizenship. Abusing the TN visa process will only make it harder for other Canadians to get. You work in a health care setting so are not subject to the yearly cap on the H1B visa, so ask your employer to file for you.

Please and please get off the TN visa as soon as you can and don't abuse the process for others. I wi be seeking my first TN visa soon and don't want long-timers like you to affect the outcome.
