Hello Everyone,

I am PR holder. As I am getting married, I came to know that my fiancee has a history of student visa rejection before. He applied three times for PG diploma and got refused saying that he would not leave the country after studies.
My concern is if I marry him and apply for spousal sponsorship does his 3 times student visa rejection effect the sponsorship application in any way. Your replies will be appreciated. Thank you.

It may mean that your relationship is now going to be more heavily scrutinized as there will be some concern that it's a marriage of convenience.

Definitely will be more scrutinized. Doesnt mean you will be automatically refused, but sending a relationship timeline letter may be a good idea to send with your application.

Thank you for quick responses.

If I provide enough documents as in Marriage certificate, pictures and relationship proof documents will it suffice. Or will they ask for anything more.

Have you guys came across any similar cases as such who have been granted the PR despite rejections under spousal sponsorship.

I tell a lot of people this, but go on the canlii website and search for similar cases. Its helped me immensely. Im sure there are cases that have gone both ways, but it may help by seeing what has helped other people, or see which documents may have been requested before submitting.
If you can, you may want to get a consultation with an immigration lawyer as well to get some more info.
