DoJ counsel and I just got off the phone with Justice Barnes, who confirmed that he will be granting leave in both IMM-1-11 (those who joined before the Liang decision) and Haiyan Hong, who represents both those who joined in or after June 2012 and those who were assessed after March 28th but not issued visas. The hearing will be in early Fall.

The statute requires the hearing to occur within 90 days of the granting of leave, and the Court goes on holiday in July and August. Thus, leave may not yet be formally announced for a September hearing.

In both cases, the main focus will be enforcing the Protocol. However, the legality of s. 87.4 will also be in issue on grounds other than those Justice Rennie's decision address. (The Federal Court of Appeal will hear the appeal of Tabingo on June 23rd but will not likely have released its decision before our cases are heard.)

When the date is released, I will let you know.

In 2005 I had filed FSW application at New Delhi visa office. Later I had withdrawn my application in Feb, 2012. Then on July 2013, I submitted the form for "return of the processing fee". However I haven't received my processing fees back yet. I wonder does anybody in this forum receive their processing fees back yet? Thanks,
 
I have just checked up the hearing dates on fedral court website. Dats are available when there is no hearing at all. then why tim case is not given hearing for 3 months ? can any one give the reasons for delaying the hearing.

As you may recall, there are two challenges FSW applicants, whose files s. 87.4 closed, have before the Federal Court of Canada. One is the so-called class-action, for which the appeal from the January 2013 denial will be heard on June 23rd. If the appeal succeeds, all closed FSW files will be re-opened.

The other is the one unfairCIC.com initiated in October 2011 and which resulted in victory on 18 June 2012 (Dong Liang). However, for those whose files s. 87.4 closed, CIC refused to honour the Agreement we had signed and filed with the Federal Court in February 2012. At CIC's request, Justice Barnes has at last verbally agreed to have our cases heard. The official word will come out in June for the promised September hearing.

On Wednesday, DoJ wants to see a list of the litigants who have joined the group – both those who joined before the Liang decision and those who joined afterwards. Therefore, if you wish to join, please do so in the very near future.

regarding passport validity

Is there any rule that at the time of stamping permanent residence visa on my Indian passport the validity of my passport should be 6 months or if not what should be the minimum validity of passport
 
Received Refund cheque yesterday.

No, but the COPR (visa) will only be valid to the expiry date of your passport.
