I DECLARE VICTORY TO OUR BACKLOG APPLICATIONS. I DECLARE VICTORY THAT IT WILL BE PROCESSED AND FINISHED WITHIN THIS YEAR 2013. AMEN.
 
I have a question . Is it that only discrimination based of origin of nation is against Canadian charter? Whether discrimination based on date of application and last come first out policy violates Canadian Charter?

First of all CIC is in violation of not only the charter, the very act of wharehousing our files and deleting it through law should be taken into account. The court has to make an issue in the delay. This is of ut most importance DOJ states that there is no discrimination, because thousand from the affected countries have been admitted to Canada, the lawyers should know that those thousands were pre 2004 cases that were processed. Not a single applicant from 2004 onwards have been processed, although CIC accepted applications and insisted on collecting the fees. Discrimination should not be the only issue against CIC.

I do not know why Chief Justice will announced and not Justice Rennie. Any way this will be good as all day and night we keep watching the website like crazy. So atleast I may now take 10 to 15 days rest. :D :D
 
OH yes and you know what....CIC already preparing himslef for the Judgement, and you will see lots of changes on our Ecas status etc. OB ...before any decision as they usually try to peep out the results earlly for their working in advance from the court. So do not worry if you got some changes and just wait and see till decision comes.

we see our all backlog file is showing elimination

Dear Backlog Friends,

Last day after 12 pm BD time(Canada time night 1 am) we see our file is showing elimination.
We are not thinking that our file is really canceled (Its temporary out) Following Reason:-

1.Before canceled file our E- status must show DECISION MADE after 1 to 2 week it will be eliminate.
This is not any system in cic direct canceled.

2.Fee Returns for Federal Skilled Worker applicants affected by the backlog elimination measure:
Your FSW application has been terminated by operation of law if:

you applied before February 27, 2008, and
a decision based on FSW program selection criteria* was not made on your application by an immigration officer before March 29, 2012.

3. Still have BEFORE February 27, 2008 Processing times for federal skilled worker applications 83 Month.

4. If 83 month have in cic side so at a time not possible all applicant 2004 to 2008 file elimination.

5. still court decision going to fever to all Backlog person hope this medial of march get final decision positive.

I know one man who apply 2010 and now he got visa waiting to fly Canad his file e status was like us not show any thing and after 3 month he get MR then PR but still his file not show in e-status.

So don't think our file is decision made, Just we need to wait approximately(last time in process out 21 days) next 21 days or within may/jun 2013 then hope we will get a good news inshallaha.

Today at the Ontario Bar Association seminar where I was honored to be a speaker – The Honourable Chief Justice Crampton announced that the Honourable Justice Rennie will render a decision on the FSW backlog litigation by the end of this month.

CIC should not open new FSW intake in May 2013, but instead, they should start processing our backlog applications starting April 2013 and clear all backlog on or before the end of 2013. CIC should learn about professionalism. To be fair, it should be first in first out and not last in first out. >:(
