Show me anywhere in that article where it said anything about:

- way back in the early 90s
- There was a court case at that time and the litigants won and all the 100,000 were accepted as immigrants without interview

Dates and the numbers may be off but the principle of winning a class action suit against CIC has precedence in the case highlighted. Tim leahy was one of the lead counsel and CIC offered to settle and ensure that the retro-active law was not binding on the applicants. A friend of mine was given priority processing and off course got his compensation.
"In 2002 and 2003, the federal government was confronted with a similar volley of court challenges to new regulations and the treatment of backlogged cases.

Ottawa offered a $2.9 million settlement to 105,000 backlogged applicants, agreeing to get rid of the new rule that affected pre-existing applications negatively, said Leahy, who led one of the lawsuits."

Obviously in this new case against the CIC, there is a glimmer of hope that applicants may win. ;D
It is definitely not as gloomy as Tuyen has tried to paint on this thread.

In any event, the verdict will vindicate either party.

Beware all litigants ,applicants,
Some maniac is creating new ids and showing edited letters from different visa offices and spreading false information.He claims that he got email from newdelhi and singapore visa office stating that his application is terminated but ecase is in process. While thousands of applicants are trying to get reply to their CSEs without result , this person is blessed with CIC's special favours!!!! Don't know what he is working for. Any one who got at least one standard reply from any of the above visa offices could easily detect that the email he shows us is fake.He could be another advisor of minister who got fired because his advices were of bad quality.

And nowhere in that article - nor in the actual judgement - was there anything about ALL the litigants being immediately accepted into Canada, no questions asked. That would never happen in a million years, and is nothing more than a delusional dream.

Oh and the biggest joke of all was the $2.9 million settlement for 105,000 litigants. So they each got $27. Wow...what a score. And after Tim took his 30%, they were left with $19 per person, while he and the other lawyers walked away with $870,000.

LOL! In any event, the verdict for this case will be out shortly. So these are really inconsequential comments.

We already know who will have the last laugh: Tim and the other lawyers, who can all buy new vacation homes and new boats, thanks to the poor saps who made them a lot richer for doing a few hours' worth of work.

Let it be so....Let Tim and the other lawyers get another luxury home for themselves.....why is it that you are so concerned about them making easy money.

hello attira! do you have other options aside from the litigation? there are many Manila VO applicants. total estimated, including dependents, is 40,000. while the litigation is going on, i plan to submit a new application by May. I am preparing my documents and will take the IELTS by April. That way I am not putting all my egg in one basket

All the backloggers were not processed straightaway, but the litigants cases had to be decided on priority and the remaining applicants had the applications processed to a conclusion over the years.

Tim was a lead lawyer in that case and so were many of the lawyers who were representing the litigants on Jan 14-16, 2013 hearing at the Honorable Federal Court this time again.

Had a few applicants not litigated in 2002/03 the whole backlog would have been dismissed then. Do you still think it is wrong to litigate against what one considers "wrong"? What if history repeats itself this time again, Tuyen? Even if the litigation fails the litigants will atleast have the satisfaction of trying to undo a grave inijustice.

You have tired your best to discourage the litigants but still not a single soul has taken your advise.

Since you are a self-appointed champion of Canada's good, you do not seem to notice the bright side of the litigation and it's benefit to Canadian economy. If lawyers are making money, why do you have a problem? They are offering a service for which the charge a fee. The litigants paid CIC and the govt used their money (and will refund it) and now they are paying the Canadian lawyers who pay taxes in Canada.... so again their monies are channelled into Canadian economy. So it is a win-win situation for Canada anyway.

I hope this helps to enrich your knowledge on the matter.
:-* Well said man +1 to you ...[size=10pt] We fight for our freedom[/size] CIC made us wait for so many years we missed out on other opportunities hoping to immigrate to Canada. We could have looked for others way to immigrate but they made us wait and finally pulled the cord off.
