Dear Mr.Matthew,

I don't want to dispute whether you writing on behalf of the candidates to Mr.Tim Leahy is right or wrong. I am not here to judge you on that.

But definitely i want to dispute you talking about the cyber cell and stuff. are you serious?? are you intimidating??? You feel you are being abused, HOW???. just because somebody oppose you, you shouldn't feel being belittled.

Brother, we all know our rights, we are matured enough to understand things. Yes, people judge on a public forum if they don't like our posts. You must take these things in your stride and move on.

P.S: I live in Bangalore, if you feel that i have abused you, you are most welcome to lodge a complaint against me with the cyber cell.

Few forum mates, first of all what is the reason for you become so arrognat, and show your identity, what are you hiding? Those who proposed a non profit service for those who lost the case (the already suffered lot) have any profit here. Total chnge of attitude is visible. Are there any percentage offered by any body for joining the poor victims of the back log elimination. Go to the link below and read and see the allegations about those who did same type of non profit help to those lost litigants. Is it the same team hiding behind the non identity. I expected this reaction and hence asked some body whom I believe. I felt that those who lost (tomorrow it could be me also as well) are going to be exploited), and the hard earned money can be lost. That was the reason I did this. Also if any body with out real identity use any abusive words further, I will be forced to complain to cyber cell and take acion. Please work hard and earn, dont give hope and ceat people. Also, If god punishes me, I will happly accept that, as I know what ever he do to me will be good for me. In fact the arguement does not deserve a replay, still I thought of resonding and make the people aware, no body more will be cheated. Others can take it in any way. Think twice before taking adecission.

A number of you have been asking me if the decision has come out. If one had come out, I am sure that you know that I would have shared it with you. Moreover, I have provided you the link to use to see what is happening on the case:

Others have asked me to tell you when Justice Russell will release his decision. I can only do so if I am clairvoyant and, if I were clairvoyant, I would have won every lottery on earth. I am not.

I am nearly as eager as you to know the result and, thus, I, too, wait every day for the decision. I am comforted, however, by the thought that it is far easier to write a decision dismissing our case than it is to write one granting us the relief we are seeking. The fact that Justice Russell, who presided over hearings this week in Toronto, has not yet released his decision implies that he is working on the wording which will give us the relief we seek while protecting the decision from being overturned in the Federal Court of Appeal.

So, I'm sorry. We just have to continue waiting. While the change in government does not guarantee success, it is a major help because it means that, if Justice Russell seeks promotion to the Federal Court of Appeal, he is not required to rule against us, as Justice Rennie did in Tabingo (the so-called class action for FSW's) and justices Boivin and Gleason did in my investor litigation, after which all three were quickly elevated to the Federal Court of Appeal.

As Section 87.4 of Bill-38 has closed all of your files, you should first try to get that revoked. As revocation of Section 87.4 of Bill-38 does not seem to be in the radar of the new immigration minister (http://www.cbc.ca/news/canada/manitoba/immigration-minister-john-mccallum-6-challenges-he-faces-1.3304602) or the new government (http://www.macleans.ca/politics/ottawa/the-trudeau-cabinet-and-its-to-do-list/, http://www.forbes.com/sites/andyjsemotiuk/2015/10/21/10-steps-trudeau-can-take-immediately-to-improve-canadian-immigration/, http://rabble.ca/blogs/bloggers/behind-numbers/2015/10/ten-promises-justin-trudeaus-liberals-could-deliver-their-firs) for the next few months, you should influence them by mounting pressure through lobbying or by filing a fresh litigation. To do this, you should first form a strong group, brainstorm among yourselves, devise strategies and then approach lobbying groups or legal experts in Canada. In the next couple of weeks, I will provide some leads and contacts in Canada, whom you may approach.

I would request our litigant boarders to chip in and help this non-litigant group whenever needed and where ever necessary. Your support, I believe, will help them greatly.

Meanwhile, I would advise the non-litigants to closely follow the 'Prospective Canadian Immigrants' public group (~1940 members) in Facebook. They are predominantly a group of ex-litigants who applied before 27 February 2008 and who got backlogged by the queue-jumping processing policy of Citizenship and Immigration Canada. Now their files have been closed by Section 87.4 of Bill-38. I guess some of you here might also be a part of that Facebook group. Find out and analyse why they have failed. They have lost all their litigation in all the three courts of Canada (Federal Court, Federal Court of Appeal and Supreme Court of Canada). Learn from their mistakes and you may ask them to join your group to strengthen yours or if needed to supplement your efforts. In that Facebook group, some members come up with great ideas, but collectively as a group they fail miserably. Having been repeatedly beaten up by Jason Kenney and Stephen Harper and having lost a significant amount of money on many failed litigation using different lawyers, this group is now extremely shy and morally down. They now seem to be a spent force with no direction or determination. It looks more like a chat group with no effective moderation or coordination or agenda or concrete action plan. It's leadership lacks resolve and professionalism. Being clueless, they are heading nowhere. It is a classic example of the blind leading the blind. They are holding a meeting on 14 November 2015 at Ludhiana, a city in the Indian state of Punjab to decide on their next course of action. Let us hope, this time at least, they do something worthwhile than merely getting together to socialize this festive season. If they really want to become a mighty force again, they will have to thoroughly introspect, dismantle their present leadership, elect a new leadership team, brainstorm for ideas and devise an action plan to get Section 87.4 of Bill-38 revoked. The invigorated or rejuvenated or refreshed group may be christened "FSW Seeking Repeal of s.87.4 of Bill-38".

Revocation of Section 87.4 of Bill-38 (that closed all of your files) does not find a mention in the 'Mandate Letter' (http://pm.gc.ca/eng/minister-immigration-refugees-and-citizenship-mandate-letter) sent a few hours ago by Justin Trudeau (Prime Minister of Canada) to John McCallum (Minister of Immigration, Refugees and Citizenship).

Now, it is obvious that revocation of Section 87.4 of Bill-38 is not of priority for the new Canadian government. Hence, it is high time for non-litigants to influence the new government by lobbying or mount pressure on the new government by filing a fresh litigation.
