annel: I believe that what you believe in is what will happen. Your lawyer might not have had the complete information when you asked, which is why a differing opinion from what some of us (including you and me) believe. Fact is, if you have not gotten any requests for update from CIC, and consequently have not submitted any updates, CIC would have considered your file closed through s.87.4. When the docket says "no reasons", it means no reasons for no decision having been made by CIC, or no reasons needed because it was closed by s.87.4.

As for annel's email to Tim, I don't think Tim refused the case. More a matter of ethics, I'm sure. Get advice from the person you designated to represent you.

not so sure that all those who updated documents from pre feb 2008 are safe.
posts from another forum member "aftisab" provides statistics of all those who are safe n those files which are terminated.

My friends pied him two months ago to join the lawsuit but their names never appeared on the court site. IT seems that he practices fraud. He keeps telling them the court does not update its site though the site is updated daily

I think you should go to another thread with your question. But since you asked anyway , yes I believe you qualify for the FSW and even for the new trade class since you can apply as a cook or chef (if you have the skills)

I found only two lead files in the below written directions of the court also 4502-11 was not updated since Oct 2nd for the reason it may not be lead file, also the hearings in 23 & 30 November apart from these two numbers the case No. 7502-11 is not reflected.

Written directions of the Court: The Honourable Mr. Justice Barnes dated 24-SEP-2012 directing The Court directs that the motions filed in YIN v MCI, docket IMM-8747-12 and TABINGO v MCI, docket IMM-5635-12 to certify those proceedings as class proceedings will be heard on Friday, the 23rd day of November, 2012 and Friday, the 30th day of November, 2012, to commence at 9:30 a.m. at the Federal Court, 180 Queen Street West, in the City of Toronto, Province of Ontario, for a duration not exceeding two (2) days; received on 24-SEP-2012 Confirmed in writing to the party(ies).

Any way our aim is to win the case no matter how many lead files or who has more files.

drsaini: From the information available from various Canada immigration forums, it seems that most of those from pre-Feb 2008 backlog who have updated their documents are not safe. For example, most of the 2004 applicants from New Delhi have updated their documents way back in the last quarter of 2008 or first quarter of 2009 itself. But CIC's data shows only a few of them are eligible. But even those few have till now not received their medical papers. The pre-Feb 2008 backlog of New Delhi visa office forms one-third (1/3) of the total pre-Feb 2008 backlog.

Even in this forum of our's, we have a member, SG57, for whom his London visa office had actually despatched the medical papers first and then later had asked him to ignore it by saying that his application is terminated by the operation of law. Now SG57 is contemplating joining a litigation group.

IMM-7502-11 is a file represented by Tim Leahy and Tim is not part of the class action lawsuit at present. IMM-7502-11 is awaiting a decision by Justice Barnes on Tim's motion. If the judge rules in Tim's favour, then the over 1300 files this IMM-7502-11 represents would be processed first by CIC. ;D Only if the judge does not rule in Tim's favour, IMM-7502-11 will become part of class action lawsuit and only then you will be able to see it along with the other two files.

Any idea what is the deadline to join the lawsuit, I found Mr. Tim is charging $ 400 + 1100 upon wining whereas the other alwyers charges only $ 500.
