Dear Litigant,
Attached is the letter I received today from DoJ, agreeing to allow our IMM-1-13 to proceed and, if the Court so rules, to allow the other litigants in our group to have their cases decided with it. Only those who were assessed before 29 March 2012 and the MI 1 files would not be included.
We still have to work out the details, but I would expect that the Court will grant leave. In fact, I would submit that it is only because the Court, by not having denied leave four weeks ago, thereby signalllng that it will grant leave, that DoJ has made the officer that it did..
However, please remember that, when the Court grants leave, it must set down the hearing for 30 to 90 days from releasing the order granting leave. Thus, until a courtroom and judge are available the Court is unlikely to issue its order granting leave.
In addition, we will have to have meetings with Justice Barnes to work out the framework. But, at least it is virtually certain that you will have your day in court. We just do not yet know what date that will be.
