Hello Everyone, I am a permanent resident living in Canada right now. I have sent in application to sponsor my wife from India. She is currently living in India. Due to some personal family emergencies I have to leave country for minimum 6 months. can anyone please advise me on how does this affect my sponsership application? Will this adversely affect my eligibility to sponsor my spouse as I will have no income?

Hi,
The rule is that the PR should be in Canada for the entire process. Citizen can leave the country or can sponsor from outside. From what I have read a lot, small vacations ahould be ok about 2 weeks. But staying outsode the country for 6 months definitely raises questions about the sponsor residence.

Being with family vs staying away from family when the processing times are taking these long.
especially ppl from countries like India where arranged marriage is a norm, it might raise flags that these NRIs have been defrauded them with false narratives

There is no rule for how long you can stay out of Canada. Even if you stay for 6 months , you will be still resident of Canada because your stay is temporary. However it is not clear that what IRCC will consider it.

Ircc official language on this below
Here is the source:
https://www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/permanent-residence/non-economic-classes/family-class-assessing-sponsor.html

As you can see this is the operational bulletin/manual for assessing family class sponsorship and specifically the sponsor.

The relevant text is:
"A sponsor must be residing in Canada, unless they are a Canadian citizen residing abroad sponsoring a spouse, common-law partner, conjugal partner or dependent child (provided that the dependent child does not have dependent children of their own) [R130(2)].

Sponsors who maintain a principal residence in Canada are not considered to be in violation of residency requirements if they:
  • take short holidays or business trips outside Canada on a temporary basis

->Yes, the whole application is paper based.
->yes, PCC is required at the time of submitting application.
->nobody can predict the processing timelines. but if you have been following the tracker lately, some of the applications submitted in june, july and august 2020 have received PPR or DM. so its all pure luck for the application to be picked up first and then it depends on the officer.
Thanks for the reply :)

If my wife is living on visit visa in another country than home country? does this effect the case?

Anywhere here with spouse already part of his/her own previous PR application as Non-Accompanying spouse and got AOR? Any Idea if the UCI remains the same for the spouse?
