As for a previous marriage w/o a divorce and applying as common law, you already have a refused case with CIC so I'd think that you should put your application together with even more care. I have seen one case that such a case worked but again, if you have an option of applying for an acceptable divorce, then why not?

CIC will consider a divorce if it is legal in the county it was issued. Why didn't they accept hers? You might want to start from there.

Actually my friend the problem is we dont know where her ex husband is now and that is very important to get new divorce. It's been 5 years since they contacted each other.so that is the reason why we dont apply for the divorce.

Yes, there is a solution for that to still get a legal divorce! They will advertise in his last location...then say couldnot be found therefore she can get a legal divorce!

ِWell, as Dr Eng X already wrote, it is possible to obtain a divorce even if the location of the ex is not known. Look up the laws depending on the her province of residence, and see what is the procedure. I'm sure it will have more paperwork, but it's definitely possible.

I just checked e-cas. Here's what it says:

We received your application for permanent residence on February 8, 2012.

We started processing your application on September 25, 2012.

Medical results have been received.

-

Her medical results have expired Oct. 20, 2012 (2 days ago).
So they started processing her app. about 1 month ago.

What's the deal now? Anyone know?

Will she be asked to re-do the medical? How will she be contacted?

I contacted with 3 lawyers before taking this decision of applying as common law. 3 of them told me that it is possible to apply common law with this situation. They said for common law living separate for long time is enough to proceed.

Do you have any experience like that before or have heard anything like this before. Please share your valuable comments after this thought of immigration lawyers. This is the reason why I proceeded to apply again.

On question 6 of the first page, we answered YES to d) and e).

Our reason was that she was invited to my brother's wedding so she applied for a tourist VISA.
She was denied.

Do you think answering YES to d) and e) was the right thing to do? Or was it supposed to be just d)? Or just e)?

They can request an extension TS on the medicals but that is great you are in process.......they may ask her to redo medicals or they may not....hopefully just do the extension but hopefully you hear something soon..... :)
 
TS, seeing IN PROCESS on ecas is great news!! They will probably do an extension on her medical. Find the thread about that because I don't know much. You should get the visa soon!

You did the right thing by answering yes to both. They will do an additional check (probably done before you went in process) to investigate the refusal. And it won't be any cause for concern. You explained in the box right?
