FBI screw up

Can anyone help with this dilemma...My wife (American) and myself (Canadian) are ready to send our outland application in. We want to land on December 14th 2014. We were waiting for her new passport and FBI background check. Passport came the other day and the FBI just sent us a letter saying her fingerprints were not done well enough. Frustrating since we actually paid to have them done professionally by law enforcement here...(in the south)...Anyway, we had to re-do and resubmit. Now we go to the back of the FBI line and it will take at least 6 more weeks. Should we wait so everything can be sent together or send application without background check then send later. Worried that it may delay or screw things up if not all sent together but on the other hand, if we wait then we wont be sending till March and we want to land in mid December if possible. My wife has never been in trouble so the check will come back clean.
Any advice is greatly appreciated and thank you in advance!

Hi,

Sorry to hear about the fingerprint fiasco!

I know that with Inland applications, sending the FBI PCC after the application is not an issue, but with an Outland application it might be deemed `incomplete' without it...and everything could be returned to you. My suggestion would be to include a note explaining the issue with your application and that you will courier the new FBI PCC immediately once you have it.

*edit* I'm sure that I insulted the person that took my prints, by asking for a second set...just in case the first set was not legible to the FBI. It was worth the extra $10 for my peace of mind, as I have them in case I get the same letter that you have.

They would send the application on to Ottawa. I would go ahead and mail your application in to Ottawa and include a letter explaining that you will submit the FBI background check as soon as you receive it since the first set of prints were rejected, write a similar note on the checklist, and include a copy of the FBI's rejection notice. It is unlikely that CPC-M would send it back based on historical experience members report in the forum (check the US Outland Applicants thread for some experiences - there's one in the last few pages IIRC).

Also, if you haven't resubmitted your request to the FBI yet, send in 3 sets of prints (along with following all the other instructions in the rejection notice re how to address the letter, etc). That way, you increase the likelihood of success!

Agreed. Include your letter of explanation and the FBI letter, that will be fine. We sent our app without several PCCs, no problems.

Oh Canadiana and Canuck In UK...Thank you for your responses...Unfortunately, we will be unable to send them our FBI print rejection letter as we have already resubmitted 2 sets of prints and they had instructed us to include the letter of rejection along with the prints. (Should have made a photo copy). I think we will give it a couple weeks, hoping we will get the background check back sooner than later and if not, send a letter along with our application stating why we have not included it. We are encouraged by the amount of posts on here that seem to think we will be approved by December if we get our app in soon. I am just cautious as I am trying hard to do this thing right the first time. It would really suck to have them send the application back as incomplete for any reason. I am super homesick and my wife is very anxious and exited to start the rest of our lives in Toronto!

I concur. CPC-M will only be doing the pre-check of the sponsor's eligibility for which the FBI certificate is not relevant. Also, CIC is much more forgiving of missing documents for family apps (vs. skilled worker, for example) and understanding of explanations.

If you choose to wait it out, make sure you double check that the versions of the application documents haven't changed (and if they have, use the new versions).

Also a tip: make sure you keep copies (scanned versions or photocopies) of everything you submit during this process!
