Hello all,

I have a great news....I have applied for my mom and brother and have received visit visa for both of them. They gave my mom visa in four days and asked for medical for my down syndrome brother. I got his visa in 10 days from the date I applied. I was truthful and open about my brothers condition and I think that really worked for me. He received 10 years of visit visa and my mom received 7 years of visa.

People who would normally be refused because of excessive demand (medical or social) have been approved in certain cases. Just saying you will pay for anything he needs is not good enough, because legally once he is a PR he can access the same services any other PR can, and the government cannot force you to keep your word.
What has worked is when the sponsor has provided a detailed plan about the care, and provided explanations about why you would be following this plan. So if you explain you will be supporting your mother and brother (and can prove you have more than enough income), show that your mother has taken care of him in India and will continue to do so in Canada (i.e., she does not intend to get a job; proof that she probably could not find a job might help - because of her age, lack of education, lack of job experience, whatever is relevant), show that you have looked into private programs for him and have already made arrangements to pay, etc. will help. Proof that he does not require much or any government support in India will also help - after all, not all individuals with Down Syndrome require a lot of special care. So proof that he is quite independent would help too.

You should note the OP's mother and brother are coming as visitors, not immigrants.

The OP wants to apply to sponsor them as well.
However, now that they have visitor visas, and for such a long time, maybe that is good enough.

I have a quick question :

Does {Heart problems, Blood pressure, high cholesterol} can lead to sponsorship refusal?

I refer to parents sponsorship.

Probably not. They estimate how much the applicant will cost the healthcare system. If it is about the average for a Canadian, they won't refuse for that reason. So if someone has high blood pressure and high cholesterol, these are normal complaints and probably would not cause a refusal. Heart problems if very serious might.

After getting my mom's and brothers visa.....i'm talking to a local lawyer here in Canada who has suggested that if you can get Visitors visa and get your brother here and get him checked by any down syndrome society or school we can show government that he is not a handicap and has very low requirement for maintenance as my mom is providing full time assistance to him.

I will be applying under Humanitarian and compassionate applications.

Having said that this doesn't mean that I won't show that my mom and me are financially and emotionally committed to his health and expenses. Thank fully my mom is in very good shape and soon my younger brother will be coming to study here and eventually working here that means I will have one more person to support us (On a side note we have a huge family here all my dad's cousin that will also play a big role in showing Canadian government that I have a support system here)

Anyone else who has applied under H&C (outside country) ? what will be the challenges ?

Don't know a lot about H&C grounds. All I know is that it is one of the longest processes to complete and it is usually reserved, not always, for those whose lives are in danger if returned to native country.

If you are going to go ahead with H&C, I suspect you got a long haul and huge challenges ahead of you. Good luck with it.

Congrats on the visa. I'm in the same boat. I have a brother (26) who has Down's syndrome and I'm applying for a visitor visa. I'm curious as to how you filled his application. Did you submit separate applications like (imm5257) for your brother or did you include his information in your moms application. In my case I'm applying visitor visa for my parents along with my brother and am confused if my we need to fill separate applications (since the guide says your dependent children aged 18 or over). Thanks

Congratulations on getting visitor visa for your mom and brother.

My case is very much similar as yours. I have applied for my mom's and dependent brother's sponsorship. My brother is 31 years downsyndrome child with 57 IQ. He is very calm and composed, and my mom provides him regular directions to complete his daily chores. Looking forward to get both of them here in Canada and live with us. Will share my experience as my sponsorship application get some progress.

When did you apply? I also applied for family sponsorship... My brother is way more dependent on my mom though. Let me know of your updates.. All the best.
