Family Sponsorship for husband in USA

Hi Folks,

My fiancé and I are planning to get married in USA around May/June this year. I'm a Canadian PR. My fiance is in USA but he is out of status. We have been together for a really long time. He came to USA as a student in 2009 but hasn't been able to maintain the status since for personal reasons. He hasn't been deported. Do we hire an immigration lawyer to file our family sponsorship application once we are married or is it okay if we apply on our own? Any suggestions would be immensely helpful.

You can apply on your own. The fact that he is out of status doesn't affect his ability to get the PR approved as long as the relationship is genuine.

You can apply on your own. You don't have to use a lawyer unless this is your preference.

Make sure he is 100% honest about his immigration status and history in the sponsorship application. He will also need to make sure he has a valid passport.

Note that once he leaves the US, he will be automatically banned from re-entering for 10 years.

Currently going through the same process...our application was denied initially (marriage not genuine). Immigration automatically assume the marriage is not genuine because of your finance status in the US. They will believe he is marrying you for status in Canada. Please keep all your travel documents to the US, phone bills, any gifts he sent you or you sent him. Your wedding pictures, know his friends, he know your friends, relationship with your family and his family.
