hello gals and guys,

my husband is a canadian citizen and we got married on March 25, 2012. My husband is a divorced. He sponsored his ex wife in 2009 as they got married in March 2008.She landed in canada in 2009. Then they separated and he got divorce papers from alberta court. now i am married to him and he wants to sponsor me in family class -spouse category. i want to know that can we apply rightnow. since we both are legally married and we have got all the documents and pictures related to our marriage. i need your help guys please guide me.

I think he still need to wait 3 years after she landed(maybe I am wrong but he can check it in his sponsorship papers relating to his ex wife)..eventhough they got separated until now she's still under his sponsorship..

well better to wait it out a bit... coz it seems like to an unbiased party, that he is kinda helping ppl gain canadian citizen ship, even though that may not be the case or isnt, but it will appear as such to the immigration ppl, and you may end up getting rejected or told to wait, i dont think you would want a rejection showing, make a casual call to the center or read up who can sponsor, esp the undertaking the sponsor signed when he sponsored the previous wife... also if i am not mistaken i think now-a-days a person cannot sponsor again for 5 years, or maybe that thing is still in the works...

well i am damn confused, i dont know what to do??? i have read that a person can sponsor after 3 years but did not read 5 year thing. please pls provide me correct reference...

Five-year Sponsorship Bar for persons who were sponsored to come to Canada as a spouse or partner

On March 2, 2012, changes to the eligibility requirements for sponsors came into force. These changes bar a previously-sponsored spouse or partner, from sponsoring a new spouse or partner within five years of becoming a permanent resident, even if the sponsor acquired citizenship during that period. Other members of the family class will not be affected by the regulatory changes.

these changes bar on previously sponsored spouse. it doesnt effect my case. since my husband is in canada till last 10 years. he sponsored someone. he was not being sponsored She29

But u said that ur husband sponsored his ex wife last 2009. So meaning he needs 2more years to be able to sponsor u as family class spouse category.

yes he sponsored her in 2009. but according to that his time period is completed in 2012. five year bar is on those persons who were being sponsored( e.g five year ban is applicable to her previous wife, she cannot sponsor anyone till 5 years)

From what is on the CIC website, it seems that the only thing that could have been an issue would be if your husband would still be responsible for his ex-wife... which is not the case as you said.

Then if you applied, you just need to convince the immigration officer that your relationship is genuine by giving them as much pictures, emails, letters, etc... the longer you've known each other before the wedding, the better.

A friend of a friend makes a living marrying guys to get through with PR. She's on her 4th marriage in 6 years. And your situation is not as serious as hers. And all 4 men she married got through with their PR btw.

this is interesting 4 sponsorship in 6 years?wow..how did she make the immigration believe her?what happened to the 3 years sponsorship undertaking?anyway..just curious..one lucky woman...lol

WOW....find that very hard to believe....seeing as you have to wait 1 year for a divorce in Canada after separation under normal circumstances...
