Dear Forum Users,

My application for permanent residence was refused in March 2012 by the ND visa office. The reason they said was my sponsor was not meeting the minimum income required to sponsor me. However, my sponsor was earning more than what was required. So we filed an appeal with the immigration appeals division in April 2012. We were scheduled for an ADR conference in June 2012 which was of no avail. Then we were scheduled for a hearing on 10 October 2012. The judge allowed the appeal.

The permanent residence application status on E-CAS shows Application Received on 04 Dec 2012. There has been no update since. I was wondering roughly how long will the actual process take from the time an appeal is allowed to the time we receive further information from the visa office?

I was reading on the internet on several law firm websites that appeal cases are processed on priority. I am just curious to know where I am at the moment so that I can plan something. Life seems to be all messed up :(

Successful appeals are first sent to CPP-O for them to create the file and initiate security checks. Depending on admissibility risks, CPP-O may finish processing or may send the file on to the visa office. Thank you for the reply. I was wondering what does the period in those phases mean? Also, have you any idea of how long all this generally takes?

I would check in the thread for your specific VO and in the appeals thread to see other people's timelines and get a sense of how long it takes for your specific visa office.
 
Thanks for the information. I have been reading around and the time frame seems to be roughly between 8 to 12 months from the time appeal has been allowed. Quite a long time under priority processing :o LOL
 
I just read on Bellissimo Law Group website that not all appeal cases are forwarded to the CPP-O. Cases from Cairo, Islamabad, and Port-au-Prince are the only ones dealt by CPP-O.
 
I won my Appeal in August. It is supposed to be processed February, hoping hubby will be with me in Canada by April/May. However, I wont hold my breath ! April will be 4 years in total !

I would count on about 9 months after the Appeal (of course depending where your file is sent)

I was told my file would be sent to Ottawa but it is sitting in Mex city.

I was guessing it would be roughly around that time. Do you think it is a good option to ring them to get an update? I have emailed ND visa office twice. No reply.
 
Send an email to the VO ND for an update on my application on the 25th of Nov and got a reply today. 10 weeks for an email reply!! And guess what, the reply was a one liner: "Email forwarded to the concerned section and you will be contacted you if necessary".
