Extension of stay Questions Please respond asap

I am sponsoring my husband, under the family class In-Canada, He is a united states citizen and we just sent in our application this past week. Now we need to extend his stay,what we are wondering is:

I just gave birth to our daughter almost 2 months ago, and I am currently unemployed, He needs proof of means to stay in Canada, We are currently being supported by my family; we are scared he will be denied an extension and he has to leave within a month and a half.

What documents can we send to help this?
Should we send the receipt for our application for sponsorship?

Should we send affidavits from my family saying they will support us?

This is the scariest thing that is worrying us, so any help and advice would be great!

Also should we send it through the mail or online?And what would he apply under?

Extension of my temporary resident status?
or
Restoration of temporary resident status as a visitor?
or
initial temporary resident permit or extension of temporary resident permit?

We don't know what to put for available funds, he has a set amount, but we are funding him on his trip. so should we fill in the amount?

We also don't know what we should include, should we include a written out explenation of our situation?

He needs an extension of his visitor/temporary resident status (assuming it hasn't yet expired). You need to show how he will be supported. If your family is supporting him, a statement from the family member(s) who will be supporting him and some sort of proof of their income should be sent. For us, my husband was supporting me, and we sent a scanned copy of his pay statement. It showed his year-to-date information, showing that his income was sufficient to support me.

If he is supported by your family I think you should include as many documents as you can to show that, and a letter perhaps stating the situation, and the need for him to be next to you to support your newborn. Include even birth certificate of the child. Of course include a copy of the sponsorship receipt. Even include a picture of the whole family :)

I would declare the situation as it is. I am guessing that since your husband is a US citizen, does he need an extension? Can't he just just go back to the border and come back ? if any other posters can comment on their experience with this or if you search the forums it will be better)

Extension of my temporary resident status is what I think you should pick as long as it did not expire.

I found the online application to be limited in what you can provide/upload (try it for yourself), but the posted processing times were faster.

On another note - did you submit an open work permit with your sponsorship application? that or a study permit? Perhaps you can send this in now and this will automatically give him the Implied Status (google it) and it will mean no need for an extension as long as his application is in progress. However, not sure if this will affect his ability to travel and come back. But again, he is in the US so should be fairy simple to visit, I guess.

And include lots of prayers - that helps tremendously. I hope this helps.

PS: I think what QuebecOkie meant is an extension for his temporary status.

PSS: I am not a lawyer nor an immigration consultant - this is my personal opinion - make sure you do your critical thinking and do what you believe in.

no - if the applcant has already been in canada for a considerable amount of time as a visitor, it is a whole lot riskier to go back to the US for a short period of time and attempt to return. there is no guarantee of reentry, and there is considerable debate as to whether we are allowed 6 mo. per calendar year or visit. It's MUCH safer for PR applicants to submit an extension for their stay so they can remain long term. I believe the OP already knows this, as it's been discussed frequently. also, if they are applying inland, than there is further risk to their application, and it can be considered abandoned if the applicant leaves.

A study permit would give implied status, just as an OWP would have, but...it's unknown if either will be effective if they are sent AFTER the Inland sponsorship application is sent. I suppose that as long as either are sent prior to him losing his visitor status, it will still give him implied status.

The advantage of an OWP, is that it does not require approval for one to have implied status, since it isn't even processed until he receives AIP.

If you haven't sent an OWP, and opt to do so now, be sure to write [in bold letters across the top of the first sheet]
OWP SUBMITTED WITH IN-CANADA SPOUSAL SPONSORSHIP APPLICATION. PROCESS AFTER AIP

If, for whatever reason, CIC was to process the OWP prior to AIP, it would be denied...which would NOT be good...obviously.

FYI- The OWP is form IMM 5710 and the fee is $155
