Dear Forum members,

I am a 27 year old male primary applicant for a Canadian permanent residence.

My current CRS points with my spouse accompanying me are 448. With the current trend in points, I will very likely get an ITA in the next draw.

My main concern with my express entry application is that my wife, from her first marriage has a nine year old boy, who studies at a local school. My wife's previous marriage ended in a divorce due to her first husband wanting to marry another women. Her first husband in the past nine years did not care about the child, he never asked for him or inquired about his son's well being. The boy's current guardians are his maternal grand parents, who he lives with. My wife from time to time visits him.

My wife is currently expecting. Due to my own family responsibilities and other concerns, I am not willing to take my wife's child with us.

My wife does not have an official document stating that her son is her responsibility or in other words she does not have a so called custody paper. My wife's first husband also does not have any paper for the boy's custody, in fact, he in my understanding was verbally informed that he could request for his son's custody after the boy becomes 7 years old, but the man never showed up and in my view cares least about this.

When I fill out the application, I would restrain in all possible ways not to lie or hide anything from the Immigration officers, however, I cannot have my wife's boy accompany me.

Please do not judge me by my statements and guide me so that I can fill the application in a truthful way and yet not have my wife's child accompany me.

Please do not hesitate to ask any questions. I would greatly appreciate your inputs and advice.

The child must be included as a dependent and medically examined. He can be non-accompanying. Does your wife share your feelings about not bringing her child?

Could you guide me on what options are needed to be selected for the child to be non-accompanying? and does any document need to be provided that stating that the child will not accompanying?

She understands that you don't want the child to come to Canada or she also doesn't want the child to come?

It is asked in the application.

No Mother would want to leave their children but in order to start a new life we have to move on from our pasts, besides this, the boy is only nine years and he is still studying in school. When he grows up, lets say 10 years from now he will meet his mother in Canada.

You don't require documents.

Know that once your wife is a PR, she can sponsor the child regardless of whether you agree or not. Make sure that you are both aware of everything that can happen.

Hi Members,

I am new in understanding Express Entry procedure and have many doubts in my mind.
Can any one let me know while applying for ECA to WES, shall i get my degrees attested from respective authority or shall I also go for attestation of transcripts of those degrees too. (Or any one of these). I have studied on WES site that the documents or degrees that need to be send to them shall show detail of passed subjects and normally those details are mentioned on transcripts, so little confused, what to do in this case?
Need guidance...

Yes. You will require either signed permission from the father or your wife will need full legal custody of the child.

Yes, permission from the father or legal custody.

Of course your wife can't grant you custody.

Canada is a signatory of the Hague Convention and this requirement is in place to prevent international parental kidnappings.

It is scary how a word such as "kidnappings" is connected to my situation. The child's father simply does not care and my in-laws & wife would strive not to see his face again. They in their lifetimes have never visited a court. My wife does not wish to file for custody as she has her child right from the time when he was born.

Looks like we anyhow have to opt for the child to be not accompanying. I know you mentioned before that if the child is not accompanying, we would not need any documents for him except for his passport and medicals. Please correct me if I am wrong with this statement.

You will not need to provide any other documentation. Who cares for the child is not a concern of IRCC.

It says

As my wife's son won't be accompanying us, should I include him here? with me, my wife and our child? it will be three of us, if we include my wife's child it will be 4.

Besides this could you tell me the other sections where his name or his inclusion is required or not required?
