Express Entry refusal

Hello everyone,

I just received a refusal letter from CIC Express Entry. Theofficer said "I am not satisfied that you meet the language proficiency threshold as the language results submitted with your application are expired. As per the Ministerial Instructions - 12(3) When the results of a language test referred to in paragraph (2)(b) are two or more years old, points cease to be assigned for the language proficiency assessed by that test and the points assigned to the foreign national under the Comprehensive Ranking System is to be adjusted accordingly. I note that at the time of invitation your language results were valid, however, on 18DEC2017 when you applied for Permanent residence your results were expired"

I had already given IELTS exam before expiration of old ielts score and my score was exactly the same. I thought my score was valid at the time of invitation so i didnt upload the new document. Can i re appeal the decision with my new ielts score which i got before expiration of my old Ielts exam stating that it was a mistake or some carelessness while uploading the document. I do not want to go through all this process again as my crs score was 436 and i do not know when will i get it again. Someone please help me and guide me the process to re-appeal the decision.

No, you dropped the ball so you'd be wasting your time by appealing the decision. You'll have to start from scratch.

Thanks for your reply. I contacted CIC with my refusal letter and new ielts score and they have accepted. My case got re-opened and they have asked for RPRF fees now.

Re-enter to EE pool but also create a CSE with the correct documentation. It's unlikely they'll re-open the case (hence why you have the EE profiile in the pool), but maybe you'll get lucky.

I have a question. I gave my IELTS on DEC 10th 2016. I already have an ITA and intend to submit my application by 30th October. I am sure by the time IRCC get to my application it will be DEC 10th 2018. Does that mean that my application can be rejected?

It needs to be valid on the date you submit your application, not when the officer gets to it.

This is a very good example of only using the advice given on this forum as a reference. No one on this forum giving advice is an employee of CIC. Follow your guts and information provided by the CIC website. There is other poster who said they received an ITA with their score below the cut off. Everyone and their mothers were telling him to decline the ITA because it would have resulted in a rejection. The person went against all advice given and applied and was successful in getting their PPR. Let this be a lesson to all hopefuls

Yeah that guy who claimed to get an ita with a score below cut off was a troll. He provided no evidence whatsoever.

What was ur VO?
Are you PNP or FSW?
Inland or Outland?

I request you to please provide some details because i also in same boat of Refusal casw.
