If your employer has applied for the LMIA but you are still waiting, you are allowed to submit your application for a new work permit within the last 2 weeks before your current permit expires, with the LMIA pending. But you also have to provide proof that your employer has applied for the LMIA (copy of application, delivery confirmation, communication if any from ESDC to your employer...)Guru_J said:But if my work permit expires while my LMIA is in process, can i still be working for my company? or will i be on implied status and so can continue working?
You are only LMIA exempt while on the PGWP. Once your PGWP expires, you need an LMIA to continue working.drandria said:I am currently under PGWP and I have been working for the same employer and my PGWP is expiring soon so I am just wondering if I need an LMIA or not? I was reading on the CIC website that international students who have graduated from a Canadian school are part of the International Mobility Program which are LMIA-exempt. I just wanna to make sure. Please help! Thanks
Only the employer can apply for an LMIA for you and only for that job. You don't know if they will apply until you ask them. It may not be approved, even if they currently employ you. Note that PGWP cannot be extended. What you are applying for is a brand new closed work permit.drandria said:Thank you very much for your reply. So to be able to apply for the extension of the work permit, I need an LMIA? So how do I know if my employer will do that for me? Does it depend on the employer or is there a list of companies who can do it ?
