Expired Study Permit. Implied status/working- Desperate please HELP!!

Hello All,

I am an international student at McGill University. My study permit expired on 18th of May 2015 but I had already applied on for renewal on 8th of May 2015.My first question would be that I am on implied status right? Also because I applied before my expiration I am allowed to practice whatever was specified on my study permit. I am allowed to work full-time during scheduled breaks. Second most important question is am I allowed to work under implied status during summer? I already signed a contract with a company in Toronto for 3 months and my start date is 25th of May 2015 but they haven't asked for any sort of legal proof that I am allowed to work legally. How should I approach HR? And am I allowed to work?

As of June 1, 2014, new rules came into effect.

Yes. You may remain in Canada as a temporary resident until CIC makes a decision on your new permit application, as long as your application to extend was submitted prior to the expiry of your authorized stay.

If the new application was submitted to renew your study permit:

You may stay in Canada and continue studying as per the conditions of your original study permit until
CIC decides on your application.

If the new application was submitted for a different type of temporary resident status (e.g., work permit):

On the expiry of your study permit you must stop any of the activities stated in the original study permit once the permit expires. For example, you may have come to Canada as a student and then applied for a work permit. If so, you must stop studying once your study permit expires. After that, you cannot work or study until you get a new permit.

Also as of June 1, 2014, if you hold a study permit and you have applied for but not yet received your Off-Campus Work Permit, you should wait for your work permit application to be processed and begin working off campus once you have received your Off-Campus Work Permit.

And as of June 1, 2014, if you hold a study permit but you have not yet applied for an Off-Campus Work Permit, you are authorized to work off campus without a work permit as long as you meet the eligibility requirements for working off campus.

The question is, have you applied for an off-campus work permit (OCWP)?

My expired study permit (the one that recently expired) was renewed last year 21st of July 2014. And they couldn't extend my study permit my until end of education because my passport was expiring on 18th of May 2015. And as per my study permit (conditions written on the study permit) I am allowed to work 20 hours during the semester and full time during the scheduled breaks. My question if I am allowed to study under implied status then should be allowed to work as well ( according to conditions on my study permit).

As a temporary resident, you must apply to extend your period of authorized stay before it ends. If you have done so, your period of authorized stay as a temporary resident is extended by law until a decision is made [R183(5)]. As such, you are considered to have implied status as a temporary resident during that period.

If as a temporary resident you applied for renewal of your WP or SP and your permit expires before a decision is made, R186(u) and R189 (the right to continue working or studying under the same conditions pending a determination of your application for renewal) apply only as long as the person remains in Canada.

So hraza90, keep working as you wait (assuming you presented a copy of your new passport!).

I was wondering if you can give me an update on your situation. Were you able to start working with your implied status as a student?
I am kind off on the same boat as well.

You can work under implied status only if you applied for a renewal or new permit before the expiry of current permit. You can't work if permit expired and you are under restoration of status.

Hii this is mandeep singh my study permit is expiring on 31 March 2018 and cic says you are under implied status coz i applied for study permit extension on feb1st. Its been more then 60 days that I haven’t got any update and when i call them they said visa officer need more varification on my profile till 20 june they can give decision. What should i do wait or ask for assistance from lawyer?????
