Hello All,

Looking for advice here.
My brother had completed his landing and has his PR since Nov 2016 and stayed in Canada approx for 30 days. He decided not to continue his PR and did not return to Canada.
His PR has expired since.

He would like to visit me in Canada now. What are the options and how could he visit me?

He need to renounce his PR status first before he could get a TRV or ETA.

He needs to renounce his PR status first. Then apply for a TRV.

True, but unless he holds a U.S. passport, he would not be able to travel back to Canada via a commercial carrier with an expired PR card. He could enter at a land border in a private/personal vehicle but would undoubtedly be reported for not meeting his R.O. to have maintained his PR status. This would very likely result in revocation of status.

Agree with @steaky and @scylla that he should just renounce his PR and then apply for a TRV.

If he starts the process of renouncing, does he have to wait until the decision is made? The process seems to be taking around 3-6months.
What if he would like to travel in the next two months?

Does he hold a visa or visa waiver passport to enter the USA?

Fly to Buffalo, cross at the land border. When asked, just visiting but plans to renounce.

He WILL be admitted to Canada. They could write the report/notification that starts the process of revocation (subject to appeal but if not appealed, PR status lost).

Or they could just wave him through and say he should renounce. This seems relatively common for holders of visa waiver passports that really are just visiting. (Possibly others too, don't know)

I believe I have heard some might pull out the forms for renunciation and ask or even pressure to sign on the spot. (I think this is just the classic 'make you think you'll be stuck for hours if you don't' tactic.)

But bottom line is that it's extra paperwork for them, they're busy and overworked, and if they're convinced you're going to leave, they might well not bother with any of that and wave you through. Worst case really is loses the status he was going to renounce anyways.

[Note, if not from a visa waiver country for Canada, no guarantee that will be able to get visa in future.]

How will he fly to Canada with an expired PR card? Not from a visa exempt country.

The poster suggested you to fly to USA first and then walk or drive to the land border for entering Canada.

Sharing some more details before finalizing the travel plans. It would definitely help if you can provide your opinion on the same.

My brother's PR details:
  • PR card expired in 2021
  • Does not meet the Residency Obligations
  • Does have a US Visa
Between the 3 options, I believe you are suggesting that the 3rd would be the quickest way to get to Canada:
  1. Renounce PR and apply for Visa (this might take >3 months I guess)
  2. Apply for PRTD. If refused, PR renounce starts and then he would have to re-apply for Visa after renouncement is completed. (this might take >3months too I guess)
  3. Fly to US and cross into Canada via land border (Immediate)
Even with secondary inspection at Peace bridge/Buffalo border, I believe he WILL be allowed into Canada (basis the note shared above) with the worst case being that the office reports him for non compliance and starts filing the revocation for his PR. That scenario should be fine too as far as he is being allowed to enter inside Canada.

Is there any necessary measures apart from the below to be taken for a bit more seamless entry with #3? For eg;
-private or commercial car (Taxi) restrictions
-COPR and landing documents along with expired PR card
-mentioning that he plans to renounce when asked
-anything related to return ticket, plans to stay, etc. if asked

Could you let me know your inputs?
