Dear all
Hope you are doing fine and well.

I am writing to you from Saudi Arabia because I need a legal assistance for my case.

I and my family have been in Waterloo, Ontario on the summer of 2010, then we became a Canadian permanent residents since 24/7/2010. Unfortunately it is expired now and we did not comply with the residency obligations in Canada.

After we became a permanent residents, we traveled back to Saudi Arabia from Canada, where I am working as an assistant professor at a university. During these years, I couldn’t leave my work place in Saudi Arabia as I was obligated to finish it. In addition. I didn’t know that we had the right to return back home to Canada after the expiry of our Permanent resident cards.

I think that we can travel to the US and cross the landing boarder to Canada, and I have a US visa but I will need to apply for a US visa for my family.
The main issue here is that my youngest child doesn’t have a PR card, neither a confirmation of landing, as he was born in Saudi Arabia after we traveled back to Saudi Arabia from Canada. He would be completing 5 years and 4 months at the end of next August (planned travel date).
Would the US and Canada crossing boarder allow him to leave USA and enter Canada.
In addition, all my children are accompanying their mother's passport (The bearer of the passport).

We badly need to return to our home Canada, because I know it is for the for the best interest for my children and for myself and for my wife also.
Looking forward to hearing from you.

Your youngest child will need a TRV to enter Canada. I believe your youngest child will need to obtain his/her own passport to apply.

Note that it's possible or even quite likely that you may be reported at the border for failing to meet the residency requirement. If this happens, you will have to appear at a hearing and should expect your PR status to be revoked. If you are able to enter Canada without being reported, you will have to remain in Canada for two years without leaving before you will be able to apply to renew your PR cards and ensure you can keep your PR status. Also note that you will not be able to sponsor your youngest child for PR until after you have lived in Canada for 2 years.

You can hardly call Canada your home when you never really lived here.

As you have been out of the country for 8 years, never lived here to begin with and have expired PR cards, you will almost certainly be reported on entry. You have no valid H&C grounds, so could expect your PR status to be revoked. There is also no guarantee you will be able to get a TRV for your child to travel with you.

On the very off chance that you manage to enter without being reported, as said above, it will be 2 years before you could sponsor your younger child. That is 2 years where he may be without health coverage and possibly unable to attend school.

Folks, So what are the alternatives do this case? I mean does he try is luck at a land border crossing? Hire a attorney to represent him? I certainly appreciate the responses but like they say "if there is a will there is a way." Thoughts?

Renounce PR and work at qualifying to apply again.

The government seriously has to change the law or have better enforcement with situations like this, and others similar.Applicants becoming PR’s, leaving the country for years, not months, but years ,and then suddenly realizing that they need Canada so much.
Then people have the audacity to complain or look for loopholes to get back into the country, when for years they could of cared less.
In my riding there was only a 500 vote spread between the Liberal and the PC, liberal won in the last election .
