Exclusion Order vs. Sponsorship Spouse

Hello Everyone :)

Will Exclusion Order affect Sponsorship Spouse. Application from outside Canada. If there is no other issues. Does it make the whole procedure slower ?
Does anyone have any experience with that? Did anyone go thru that with positive answer ? :-[

Yes - an exclusion order certainly affects spousal sponsorship. The processing of the application will be put on hold until the exclusion period has passed.

Alternatively you can try applying for Authorization to Return to Canada (ARC) if you want to effectively shorten the period of the exclusion order. However it's my understanding that ARCs really aren't processed that quickly. So you may be better off just waiting out the exclusion order

scylla, for example if my VO processing time is 14 months, my exclusion order ended in may 2014...will they start counting 14 months from may?

No they don't.

If there is a year ban then and the processing times is 14 months then you have nothing to worry about. Someone on the Kingston forum had a year ban and 3 weeks after that passed they got PPR. So 1 it doesn't always slow it down and 2 the year ban is part of the wait time.

As for ARC's they are requested by the visa office when they are ready to continue on with your file. This also happens to someone on the Kingston forum. Her hubby had a lifetime ban and they were requested to do the ARC and a few months after those fees were paid and the letter was sent in they received PPR. An ARC is only requested when there is a lifetime ban and not a year ban. You will have to check to see what was added to any papers the person got who was asked to leave Canada to see what they say.

With this being said...all VO's work things differently as we all know. So just be prepared for anything.

i have a 1 year ban, in may 2014-it expired. i have a waiting of 12 months. my vo is 14 months. im worried

HI to everyone...
im happy that i actually find that there is outside some people with similar or same questions and problems like me.
so this is my story..if anyone have any kind of suggest or advice i would be grateful.
i got the exclusion order because they found me lying when i was interviewed on airport.
the court was actually on 13, August., since then i still didnt get not any kind of written decision,so im supposing that it will take about few months to get that.

anyone have idea how long does it take to get that decision by post mail? and how long will take to exit Canada?
i am here with small kid,and my husband who actually landed before me few months is getting his TWP.
So,can i apply for my application while waiting all this case with EO to solve?
PLEASE HELP..
we already spent so much money on consultants that im going crazy... :-[

As mentioned by scylla, an exclusion order is a game changer for someone applying for PR, because they are now inadmissible to Canada until the exclusion order has expired.

if your exclusion order has already expired, then there is no issue. i had an expired one on my record, and had no delay in processing. if the exclusion order is up, it is up. the fact you are applying for PR suggests you are now aware and are following the rules.

An exclusion order makes you ineligible to enter Canada until the exclusion order expires. This includes TWPs.
