Hi,

Me and my parents got the PR card on September 2007. All three cards are going to expire on October 8, 2012, that is this year. None of us has stayed in Canada 730 days. If we arrive in Canada on September 22, will we be deported? And is there any chance that we could stay there and apply for renewal of the PR card?
Oh, in these 5 years period, we have visited Canada 3 times. But the total time of staying was only 4 months. Please reply.

Hi
According to the rule of renewing your PR you should have stayed in Canada for at least 730 day so it will be very difficult for you to prove your intent of staying in Canada permanently as you never showed your intent. As far as deportation that might not happen they would not renew your PR till you could prove you have stayed in Canada for a tleast 730 days after landing. So you can still go ahead but if you leave canada again before getting your new PR then you might never be able to get back. So in short there is a chance you will be given a hard time at the airport but once you get in the only option you have is to complete your 730 days and then apply for an extension of PR. Again this is my opinion please wait for other folks on this forum to reply.

It is possible that you will be given a hard time at the airport depending on if the immigration officer figures out that you do not meet the requirements, if they believe that you are lying to them or if you state good reasons for not being able to meet the requirements.

Worst case scenario is if the immigration officer knows that you do not meet the requirements and does not like your reasons for not having met them and does not feel like giving you another chance, they can report you for not meeting the requirements which means they still allow you to enter Canada but give you 30 days to appeal their decision. If you lose your appeal, you lose your PR.

If you get into Canada without being reported, even if they give you a hard time, you can stay in Canada for 2 years at which time you meet the requirements again and then you can apply to renew your PR cards. You should not leave during the two years and you should not try to renew your cards until you have 2 years.

Hello,
Thanks for the reply guys. Anyways, I am in Canada right now and we got out of the airport very easily. Lucky, I guess. The immigration officer in the airport didn't ask us anything at all.

That is good news. I certainly hope that you intend on remaining in Canada for the next 730 days before you apply for a new PR card or try to leave Canada. Such luck is difficult to come by twice in one life.

Dear all, I entered through Pearson Airport, Toronto, ON. And yes, I will stay in Canada for the next two years. Ok. one thing I have noticed in the airport is that if you dress up like a normal Canadian, the immigration bothers you less. I mean if you are clad in saree, slawar kammez etc. regional clothes, there are more chances that you will bebothered at the airport.

Hi Sarmin

What kind of questions did the customs officer ask you? Did he ask how long you stayed out of the country and why?

It'd be great if you could tell us the whole story from beginning to end!
