Employment letters from dead companies

Good afternoon everyone,

First a little background. I am Venezuelan born and I am now residing in Australia as a citizen, I plan to apply for a Canada permanent resident visa next year when the cap gets reset (my profession is filled).

Some of the companies for which I have worked over the past 10 years have either got a new name, moved countries and logo or just plain disappeared, so I want advise in how to best address them:

Case #1.
Sistemas Dered (Venezuela) disappeared and reopened in Mexico under a different name. I worked in this company from 2003 to 2008 so I really need their support.

I have spoken with the owner and he can write me a letter with the old letterhead (although he might not have the seal anymore) dated for now. Would this be fine? Should it be instead be under the new company but explaining what happened with the old one? Should it be backdated to 2008? If it is with the new letterhead, then what do I do with all the payslips?

Case #2.
Bizexpress (Australia) went international and changed names. They are in the same office.

They can make me a letter with the old letterhead and will answer the phone without problems as well. However, should it be with the old letterhead? Or the new one? Again, if it is the new letterhead, then what can I do about the payslips?

Case #3. This is the worst case (and the best company I have ever had the pleasure to work with).
Directory Concepts (Australia) disappeared in 2011.

I contacted by old manager and he can get me a letter with the company letter head and provide his contact details, however, there is no website, offices and there might still be some legal proceedings regarding its demise. What to do in this case?

In such situations where company no longer exist, you have to write the reference letter yourself ,you will tell them the reason why the company is no longer in existence, describe your duties, position held, state salary and the number of work hours/week. Then, you will attach some evidence to show that you really worked in the said company when it existed e.g letter of employment, confirmation, promotion letter if any, pay slip etc. hope it helps, good luck.

Good day buddy,

As per my understanding, don't get reference letters on old letterheads in any case because it might be considered as cheating.

For case 1, get the refenrece letter from your supervisor/manager if he is still working in the new company or from CEO/management on new letterhead with fresh date on it. Ask them to provide any proof which can show that this company was working with other name in Venezuela.

For case 2, similar to case 1, get the refenrece letter from your supervisor/manager if he is still working in the company or from CEO/management on new letterhead with fresh date on it. Ask them to provide any proof which can show that this company went International and changed their name.

For case 3, get the refenrece letter from your manager his new company's letterhead with fresh date on it. Try to obtain any proof which can show that this company has been shut down.

In all above cases, get the buisness card of the signing person and send it to CIO along with reference letter and related proof. Please note that Paysilps are not mandatory to provide. You can skip them or provide them along with the proof of name change or shut down.

This is just my understanding ONLY. Try to get an experienced say on this.

Couple of other actions that can substantiate your positioning -

1) Bank Statements that show your salary details from past.
2) The note you make by yourself, carries more weightage, if its notarized.

I can certainly write the letters myself, in fact, I am doing it for all of them anyway. The companies will then review the letters, make any required changes and send them to me in the proper letterhead.

Regarding company #1.
Would it be cheating to get the old letterhead? I am guessing the company still exists on paper (although the website is dead) and I would like to use the CEO as he is willing to send me the letter. Maybe in the letter I could clarify that it ceased operations in Venezuela on mm/yyyy? Or would it be a better idea then to ask my manager to send me the letter on the new letterhead and include that note as well as his position on that company? CEO

Regarding company #2.
This company is very much alive and the website even points to the the new entity. I would still rather use this guy's support and get a letter from him instead of only from me. Maybe old letterhead and with a note as suggested that it went international on mm/yyyy and changed names? Or would it be better with the new letterhead? (same as above)

Regarding company #3.
This is a delicate one... I can see the insolvency notice online, I could print it and send it with my application. So using this company's letterhead would be seen as cheating? It would be by either my manager or the CEO of the company. Maybe a good alternative would be for me to get a reprint of an old letter from one of them (backdated)? And include a letter from myself as suggested (notarised) as well as a couple of payslips, etc, etc

What do you think?

By the way, do you guys think there is any chance of my quota to get extended / reset before april? It is one of the quotas that fill up very quickly, I believe its number is 2174.

It might be considered cheating, since the company does not exist anymore. Therefore, it can not state anything. The new company should confirm your employment by its predecessor. They should also state, that they are the genuine succesor of the suspended operation, which had employed you (with emploament and payment details).
Also, you might have other evidence of the employment (e.g. payslips, etc.).

ad 2)
same as #1

ad 3)
same as #1, if you can get anything from the former manager. Add the insolvency note and anything you still have (e.g. payslips). Do not backdate. Add a cover letter explaining the whole situation.

Hi Evryone

My situation is similar to rluengo

I have the complete set of documents (original) of my residency application on 2008: work letter, functions list, work description, payslips, contracts, all dated up to 2008. I worked for that company almost 6 years (since 2002). The company does not exist anymore since 2009. I can provide a letter explaining this and provide phone numbers of some people that worked with me but I can not get a work letter with current date.

Can I use those documents to apply to Canada?

Question. When is it a good idea to notarise a document? (expeeeeensive) Would it be the same to have a Justice of the Peace certify them? (cheap)

I ask regarding the documents we have been discussing here. i.e. a letter from me explaining the company situation, a letter from the manager of a gone company certifying I worked there but without letterheads as it would be cheating, an employment letter with letterhead included.
