Employment letter-substitute

Hi

I am applying under CEC. i am working in canada for the same employer for 5 yrs. my work permit has occupation as "computer programmer " for 3 yrs and " media developer" for 2 yrs but both fall under same NOC 2174.

My company has a policy not to issue employment reference letter for PR purposes. So i am planning to attach the letter provided to me on their letter head for my visa application

It provides informtion on my job title (per my latest work permit), job responsitbility, duties,place of work, work hrs details and also salary. In additional to it, i am including 4 yrs T4 , bank statement showing salary being credited from my company and 6 months pay stubs.

Would this letter be sufficient although it is obtained for a different purpose. This letter is up to date and 1 mon old.

Experts/Seniors, pls help. i am thinking of any legal notice i could send to my employer for refusing reference letter....your help is greatly appreciated and will be timely as i am leaving canada in 10 days

For all the viewers benefit, i checked with CIC call centre and they said as long as the letter has all the information needed, it doesnt matter if the letter is issued for other purposes.

It helps that the letter is recent. Some have tried to use letters that are a year or more old and they have been refused.

Don't forget your most recent Notice of Assessment.

I got a letter in april 1st week and can i use the same letter if i am mailing my application in last week of April..

Hey, I found a link that hopefully will be of some assistance to you about proof of work experience. See page 4 - 9 (Practice points applicable to both streams) - it lists 5 documents you can provide with a detailed explanation in the event that your employer can't or doesn't want to provide an employment letter. I would not bother with serving legal notices - it'll waste your money and time.

It's an interesting document to be sure, I would just caution that it is one lawyer's opinion written in 2009. What we have seen from CIC in the past year is that a (an old) job offer letter is not accepted as a substitute for a recent Letter of Employment, etc...

It is definitely a problem - perhaps flaw in the design of the program - among legitimate applicants, it seems to hurt mainly people working for multinationals, intracompany transfers, etc. I still find it difficult to believe that any legitimate Canadian employer would refuse to provide such a letter. But it seems there are lots of shady ones, willing to prey on desperate would-be immigrants...
