Hey...
I'm refugee claimant since 2 years and waiting for my hearing date till now.My husband is included in application as a spouse but recently he lost his patience and want to withdrew the case as he feels he can be eligible as skilled worker permanent residency in Canada.
now the concern is,if he withdraws from the refuge,will he be eligible to apply for pr being here in Canada or he needs to apply from his home country which obviously takes longer period and doesn't want to leave Canada .He wants to apply from buffalo,NEWYORK so that it takes shorter period.
Plz let me get some info .....

Hi Daze,

If he is a legal resident of Canada, he may be able to apply as a skilled worker. If he has been legally working in Canada for 2 or more years, the Canadian Experience class is faster than the skilled worker class.

I don't know for sure, but think if you withdraw the case you may lose your right to legally reside in Canada, and you would have to leave. You can still apply from outside Canada, but might not look good to withdraw. But why withdraw the claim? I don't think there's anything wrong with applying for both.

Check with your immigrant or settlement organization where you live, or call CIC. No one here is answering because we don't know much about refugee claims...
