A refugee claimant, while awaiting for an IRB hearing in respect of his
refugee claim, was working for 2,5 years in Canada in an occupation defined
as NOC “A” skill level category. During this time the claimant hold a
valid work permit, so his work experience was acquired working legally.
Before final determination in respect of his claim was made, he withdrew his
claim and left Canada on his own.
Within one year after he left Canada, he decided to apply to come back to
Canada as a Federal skilled worker on point basis using the same 2,5 years
experience which he earned while he was a refugee claimant. As well, he
heard that he is qualifying as a Canadian Experience Class applicant –
worker stream, for working in Canada for 2 years in a high skill
occupation.

Will the visa office recognize his work experience he collected
while he was a refugee claimant for his Federal skilled worker class
and/or Canadian Experience class?

Thanking you in advance for all your help.

Probably. It is Canadian work experience.

Not counted for CEC From the guidelines.

Note: Foreign nationals such as refugee claimants in Canada and workers without status (undocumented) are not eligible to apply under this category.

I have another question if you can help me out.

A grade 3 student from germany wants to come to Canada to study but her mom is already in Canada on study permit and work permit does her daughter need a study permit?cic website is confusing some places they say minors do not need study permit and some places I read that if a minor is coming from outside Canada they must apply for study permit.

Thanking You In Advance.
