Hi,

My parents divorced when I was little, ever since then they share custody of me. I was born outside Canada after my mom became a Canadian permanent resident, but before she became a Canadian citizen. In the other hand, my dad doesn't have status in Canada, and we all currently live oversea.

As I grew older, my mom intends to sponsor me to become a Canadian permanent resident. To do so, she planned to settle down in Canada with me.
We have been told that my mom can only sponsor me if she gets sole custody of me, but I just wondering will that prevents me sponsor my dad in the future (if the parents sponsorship category available again)? and is it really necessary to have my dad sign away custody of me so I can be sponsored by my mom?

Need help, thanks!

Jane

A few more details are needed. Your age, occupation etcetera.

In that case, I can't see any reason why your mother should not be able to sponsor you as you are. She will need permission from your father to do so I suspect and will absolutely need his consent to take you to Canada. Apart from that, I am not aware of a requirement for sole custody to make the application.

Thanks so much for your reply Zardoz! :)

Just wondering if my dad gave away the custody, will I be able to sponsor him to Canada in the future?

As you would have to be an adult to sponsor anyway, I don't see that custody would have any relevance. It wouldn't change the fact that he is your father, so I would say "yes".

I wanted to give you my experience as a parent sponsoring a minor child (11 years old). I have submitted my packet and I used an attorney to help me because I wanted to make sure everything was legitimate for the sponsorship since a minor child is involved. I submitted proof of custody via a court order (it shows my ex-husband and I have joint custody but my son lives with me primarily.) I also had my ex type a formal letter stating that he approves of my son coming to live with me in Canada. I had him take the letter and have it notarized so as to prove it is a legitimate document. My lawyer thinks that is more than sufficient to allow my son to be processed. I am still awaiting first contacts from my visa office so we will see in time if this is sufficient or not. I hope that helps. :)

Thank you so much for the helpful information, my dad is a great dad, I don't want to leave him behind in his senior days.

Thank you so much for sharing your valuable experience! :)
Do you mind to keep me posted when you get a result from the visa office? Thanks again!
